527 Mr. Michael Downs, Zoning Administrator, presented the following corrective rezontng and text amendments which were being recommended as a result of the Small Area Plan. (1) Petition 90-08(t). Cabarrus County Planning and Zoning Staff. Section 3.2- 4, "Schedule of Use Regulations". To add and delete allowed uses in the C-1 zoning district. The Planning Board voted 4-0 to recommend approval. There was no one present to speak either for or against the proposed text amendment, and Chairman Lentz closed that portion of the hearing. (2) Petition 90-09(t). Cabarrus County Planning and Zoning Staff. Section 3.2-4, "Schedule of Use Regulations," and Section 16 "Definitions". To change the line item "Clubs and Lodges" to "Civic Organization Facilities". The Planning Board voted 4-0 to recommend approval. There was no one present to speak either for or against the proposed text amendment, and Chairman Lentz closed that portion of the public hearing. (3) Petition 90-13. Cabarrus County Planning and Zoning Staff, N.C. 73 East, Cold Springs, and Irish Potato Roads. Wish to rezone from C-5 to ARR/C- 1. From C-5 to ARR; Map/PIN's 5640-89-7177, 99-1653, and 99-2711. From C-5 to C-i; 5640-89-9468, 89-9629, 89-7514, 89-5593, 89-6837, 89-4584, 89- 3503, 89-9189, and 98-7559. The Planning Board voted 3-1 to recommend approval. There was no one present to speak regarding Petition 90-13, and Chairman Lentz closed that portion of the public hearing. (4) Petition 90-07(t). Cabarrus County Planning and Zoning Staff. Section 3.1(R) "District Statement of Intent", and Section 3.2-4, "Schedule of Use Regulations". To delete the C-5 zoning district. The Planning Board voted 4-0 to recommend approval. There was no one present to speak either for or against Petition 90-07(t) and the public hearing was closed. Chairman Lentz opened the meeting for anyone who would like to speak regarding the Small Area Plan or any of the proposed atlas or text amendments presented by Mr. Downs. Persons speaking in support of the Small Area Plan were as follows: Mr. Tom Small, representative of the Concord Junior Chamber of Commerce (Jaycees); Mr. Robert Amos, resident of the community; and Ms. Iris Barnhardt, resident of 123 Irish Potato Road. Each speaker also commended the Planning staff for the preparation of the Plan. There was no one else present to speak regarding the Small Area Plan or proposed amendments, and Chairman Lentz closed that portion of the meeting. UPON MOTION of Commissioner Simmons, seconded by Commissioner Hamby and unanimously carried, the Board adopted the "Small Area Plan for the Cold Springs Road/Highway 73 Community" as prepared by the Cabarrus County Planning Department and approved by the Planning Board on July 18, 1990. The Plan is on file in the Office of the County Manager and is hereby included by reference as a part of the minutes. UPON MOTION of Commissioner Simmons, seconded by Commissioner Hamby and unanimously carried, the Board approved Petition 90-09(t) to amend Section 3.2- 4, "Schedule of Use Regulations" as follows: Section Number and Name: Section 3.2-4 Schedule of Use Regulations Section 16 Definitions To change line item "Clubs and Lodges: to "Civic Organization Facilities". To insert a definition for "Civic Organization Facilities" which is as follows: -A meeting place for organizations which promote civic enhancement including but not limited to Civitan Club, Jaycees, Rotary Club, Masons, Chamber of Commerce, Lions Club and the like.
