Ruffin, County Manager, reported that the Board would be <br />asked at its first meeting in November to determine if funds should be <br />discontinued to those non-profit agencies that have not returned an executed <br />contract for Fiscal Year 1990-1991. A second letter has been written to those <br />agencies requesting the return of the executed contract. <br /> <br />UNFINISHED BUSINESS <br /> <br /> Mr. Bob Farris, Environmental Health Supervisor, reviewed the proposed <br />Water Quality Management Program which had been presented to the Board in June, <br />1990. He recommended that the Board enter into a Memorandum of Agreement with <br />the North Carolina Division of Environmental Management similar to the one <br />between Mecklenburg County and the Division of Environmental Management. Mr. <br />Farris noted that the State will supply training and analyze the samples taken <br />by the county; however, he stated that approximately $5,000.00 would be needed <br />to purchase equipment to be used by the Environmental Health staff in conducting <br />the program. <br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner Melvin with <br />Commissioners Hamby and Melvin and Vice-Chairman Moss voting for, the Board <br />authorized the development of a Water Quality Management Program in Cabarrus <br />County along the same lines as the program in Mecklenburg County as set forth <br />below. <br /> <br /> MEMORANDUM OF AGREEMENT <br />TO PERFORM A WATER QUALITY MANAGEMENT PROGRAM <br />IN MECKLENBURG COUNTY, NORTH CAROLINA <br /> <br />AGREEMENT <br /> <br />PURPOSE <br /> <br />SCOPE <br /> <br />The North Carolina Division of Environmental Management (DEM) hereby <br />agrees with the Mecklenburg County Board of Commissioners (the <br />"Board") while exercising the powers of a board of health, which <br />powers it has assumed and conferred upon itself by action taken <br />pursuant to G.S. 153A-77, that Mecklenburg County will perform <br />within its jurisdiction those functions of a water quality <br />management program described below. It is understood that if the <br />Board of Health should ever be reestablished by the Board, the Board <br />of Health shall be the party responsible for carrying out the duties <br />of the Board stated herein. <br />The purpose of this document is to describe a broad working <br />agreement between the Board and DEM which will most effectively <br />protect and enhance the quality of water in Mecklenburg County. <br />This goal will be accomplished by establishing the basic functions <br />to be performed by the Board in general terms. The specific <br />methods, procedures and protocols of each duty will be described in <br />the annual work plan. Lastly, it is the intent of this agreement <br />that both parties perform their respective duties in a manner which <br />provides timely communication, sharing of information and resources, <br />and which demonstrates a spirit of cooperation to best accomplish <br />the goal of the arrangement. <br />DEM does not relinquish any of its responsibilities, powers or <br />authority by the execution of this agreement. The functions to be <br />performed by the Board or its designee are described as follows: <br />National Pollution Discharge Elimination System (NPDES) Duties As <br />will be more specifically provided in the work plan, for minor NPDES <br />sources: <br />A. Conduct on-site investigations during the initial <br /> application phase of the permitting process. <br />B. Conduct on-site inspections during construction of <br /> permitted facilities. <br /> <br /> <br />
