546 <br /> <br /> C. Sample, analyze and interpret NPDES discharge and <br /> ambient water quality parameters. The North Carolina <br /> Division of Environmental Management Laboratory <br /> protocols will be followed and all lab facilities <br /> utilized must receive certification under DEMOs <br /> certification program. <br /> D. Sample, analyze and interpret ambient stream parameters <br /> and groundwater parameters, where appropriate. <br /> E. Receive and interpret self monitoring data from NPDES <br /> sources. These data will be supplied by DEM on a <br /> periodic basis. <br /> F. Investigate complaints and incidents involving NPDES <br /> permit holders. <br /> II. Non-Discharge Wastewater Permitting Duties <br /> A. Conduct on-site inspections during construction of <br /> permitted facilities. <br /> B. Investigate complaints and incidents involving non- <br /> discharge permits. <br /> III. Incidence Response Duties <br /> A. Respond to all incidents involving potential <br /> contamination of the surface waters and groundwaters of <br /> the state and take action to contain, control and <br /> correct the situation. DEM reserves the right to assume <br /> lead authority whenever necessary. <br /> IV. Well Construction Duties <br /> Conduct well inspections and otherwise communicate with the <br /> groundwater industry to insure that DEM well construction <br /> standards are met. <br /> V. Reporting duties <br /> Submit timely reports as required to DEM concerning Articles <br /> I IV above. <br /> VI. Work Plan Duties <br /> Submit a work plan to DEM on an annual basis containing a <br /> description of the methods, procedures, and protocols to be <br /> used and the responsibilities for both DEM and the Board. The <br /> detailed work plan will be negotiated on at least an annual <br /> basis. <br />PENALTIES The DEM shall retain exclusive authority and responsibility for the <br /> assessment of administrative penalties or for instituting legal <br /> action for violations of State statutes and regulations. <br />COORDI- The staffs of DEM and the Board will make all reasonable efforts to <br />NATION coordinateactivities. When coordination is not possible, nothing <br />OF will preclude either DEM or the Board from conducting its activities <br />ACTIVITIES unassisted.
