Taylor .17 ac <br />4690-11-6163 Little Investment Co. 24.53 ac <br /> <br /> UPON MOTION of Commissioner Simmons, seconded by Commissioner Barnhart and <br />unanimously carried, the Board appointed Commissioner Carpenter as the <br />Commissioner representative on the Cabarrus County Board of Health. <br /> Motion was made by Commissioner Payne and seconded by Chairman Simmons to <br />reinstate the full five percent (5%) County contribution to the 401(k) <br />Supplemental Retirement Income Plan effective January 1, 1991 with the <br />additional funds of $140,000.00 to be appropriated from the intangibles tax <br />revenue. <br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner Simmons and <br />unanimously carried, the Board postponed consideration of the reinstatement of <br />the 401(k) Supplemental Retirement Income Plan contribution to five percent (5%) <br />until the next meeting and directed the County Manager to prepare the necessary <br />budget amendment to provide funds for the increase in the 401(k) contribution. <br /> Commissioner Carpenter proposed the establishment of a committee to <br />develop an Ethics Policy for Board members and County employees. <br /> UPON MOTION of Chairman Simmons, seconded by Commissioner Barnhart and <br />unanimously carried, the Board appointed Commissioners Carpenter and Barnhart <br />to a committee to develop an Ethics Policy for Board members and County <br />employees and to bring a proposal to the Board at its first meeting in January. <br /> UPON MOTION of Commissioner Barnhart, seconded by Commissioner Carpenter <br />and unanimously carried, the Board authorized and directed the County Attorney <br />to draft such legislation as is necessary to provide for a referendum process <br />in Cabarrus County which would allow for the recall of any elected official or <br />officials within Cabarrus County. The legislation should include the following: <br />that there be a requirement of a petition signed by at least 20 percent of the <br />registered voters in the jurisdiction; that the Board of Elections hold a recall <br />election within 60 days of signature verification; that upon the certification <br />of the elections results, the office in question be declared vacant immediately; <br />and that the Board of Elections hold a subsequent election within 120 days of <br />the recall election results being finalized for the purpose of filling the <br />vacancy created. The Board further authorized the County Attorney to survey <br />other states and to alter the proposed legislation as it appears appropriate. <br /> The proposed legislation is to be brought to the Board for its review and <br />approval at the first meeting in January. <br /> The Board by consensus authorized Mr. Michael M. Ruffin, County Manager, <br />to continue his current policy whereby capital outlay requests for new equipment <br />during the fiscal year will be brought to the Board for approval. <br /> Mr. Michael M.
