Taylor .17 ac 4690-11-6163 Little Investment Co. 24.53 ac UPON MOTION of Commissioner Simmons, seconded by Commissioner Barnhart and unanimously carried, the Board appointed Commissioner Carpenter as the Commissioner representative on the Cabarrus County Board of Health. Motion was made by Commissioner Payne and seconded by Chairman Simmons to reinstate the full five percent (5%) County contribution to the 401(k) Supplemental Retirement Income Plan effective January 1, 1991 with the additional funds of $140,000.00 to be appropriated from the intangibles tax revenue. UPON MOTION of Commissioner Hamby, seconded by Commissioner Simmons and unanimously carried, the Board postponed consideration of the reinstatement of the 401(k) Supplemental Retirement Income Plan contribution to five percent (5%) until the next meeting and directed the County Manager to prepare the necessary budget amendment to provide funds for the increase in the 401(k) contribution. Commissioner Carpenter proposed the establishment of a committee to develop an Ethics Policy for Board members and County employees. UPON MOTION of Chairman Simmons, seconded by Commissioner Barnhart and unanimously carried, the Board appointed Commissioners Carpenter and Barnhart to a committee to develop an Ethics Policy for Board members and County employees and to bring a proposal to the Board at its first meeting in January. UPON MOTION of Commissioner Barnhart, seconded by Commissioner Carpenter and unanimously carried, the Board authorized and directed the County Attorney to draft such legislation as is necessary to provide for a referendum process in Cabarrus County which would allow for the recall of any elected official or officials within Cabarrus County. The legislation should include the following: that there be a requirement of a petition signed by at least 20 percent of the registered voters in the jurisdiction; that the Board of Elections hold a recall election within 60 days of signature verification; that upon the certification of the elections results, the office in question be declared vacant immediately; and that the Board of Elections hold a subsequent election within 120 days of the recall election results being finalized for the purpose of filling the vacancy created. The Board further authorized the County Attorney to survey other states and to alter the proposed legislation as it appears appropriate. The proposed legislation is to be brought to the Board for its review and approval at the first meeting in January. The Board by consensus authorized Mr. Michael M. Ruffin, County Manager, to continue his current policy whereby capital outlay requests for new equipment during the fiscal year will be brought to the Board for approval. Mr. Michael M.
