633 <br /> <br />ZONING PUBLIC HEARING <br /> At 7:00 P.M., Chairman Simmons stated that this was the date and hour for <br />a public hearing for the proposed Zoning Atlas and Text amendments. Dr. Nancy <br />Randall, Planning Board Chairperson, presented the proposed amendments as <br />recommended by the Planning Board. <br /> <br />Zoning Atlas Amendments <br /> (1) Petition 90-15. Planning and Zoning Department. Hearing to <br /> reconsider action on areas number 2, 6, 11 and 12 which the <br /> Commissioners requested at their November 19, 1990 meeting to <br /> be reevaluated and returned for possible action. Request is <br /> to consider rezoning of some A-I properties to more <br /> appropriate zoning districts. Maps and exact requests <br /> available at the Planning and Zoning Department offices. The <br /> Planning Board voted 5-0 to recommend the proposed amendment. <br /> <br /> Properties proposed for rezoning were identified on Section maps as <br />follows: <br /> <br />Section: #2 <br />Location: Rustic Lane, Rural Drive, Highway 73 West <br />Number of Parcels: 39 <br />Recommended Rezoning: RMF-7A for all parcels <br /> <br />Section: #4/#6 <br />Location: Poplar Tent Road <br />Number of Parcels: 3/42 <br />Recommended Zoning: A-I/R-40 <br /> <br />Section: #11 <br />Location: Pitts School Road <br />Number of Parcels: 10 <br />Recommended Zoning: R-40 <br /> <br />Section: #12 <br />Location: Pitts School/Blackwelder Road/Highway 49 <br />Number of Parcels: 92 <br />Recommended Zoning: R-40/A-I <br /> <br /> Mr. Mike Downs, Zoning Administrator, reviewed the location of each of the <br />areas proposed for rezoning. <br />Chairman Simmons opened the public hearing for Petition 90-15 at 7:15 P.M. <br />Mr. Tom Craig, owner of property located in Section 6, objected to the <br />proposed R-40 zoning classification for his property which he stated is located <br />across the road from a gravel pit. He requested additional study and objected <br />to the quickness in which the proposed A-I zoning changes had been considered. <br /> Mr. Sam Davis, Attorney representing the Zeb D. Cochran heirs who own <br />property located in Section 11, opposed the rezoning of the two tracts of <br />property from A-I to R-40. He stated in his opinion that the highest and best <br />use of the two tracts, which are located in the vicinity of the Charlotte Motor <br />Speedway and the Town of Harrisburg, continues to be A-I and not R-40. In <br />conclusion, he asked that the property remain A-I in order to serve as a <br />transition zone between the R-40 zoning district and the industrial district. <br /> Ms. Catherine Schley, representative of the Carolando Neighborhood <br />Association, and Mr. Wayne Richards spoke in favor of the R-40 zoning <br />classification. They stated the R-40 zoning classification is needed to <br />preserve the residential character of the neighborhood and to protect the area <br />from adverse uses. <br /> There was no one else present to speak regarding the proposed rezoning, <br />and Chairman Simmons closed the public hearing on Petition 90-15 at 7:35 P.M. <br /> The motion by Commissioner Hamby to approve the zoning changes as <br />recommended with the exception of those properties for which objections were <br />raised by Mr. Thomas Craig and Mr. Sam Davis failed for lack of second. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Barnhart with <br />Commissioners Payne, Barnhart, and Carpenter and Chairman Simmons voting for'and <br />Commissioner Hamby voting against, the Board approved Petition 90-15 as <br />recommended by the Planning Board and Planning and Zoning staff to rezone <br />property in Sections 2, 4/6, 11, and 12 as follows: <br /> <br /> <br />
