634 <br /> <br />Section #2 - RMF-7A for all parcels <br />Section #4/6 A-I/R-40 <br />Section #11 - R-40 <br />Section #12 - R-40/A-I <br /> <br />The properties rezoned from A-I to RMF-7A and R-40 are shown on the official <br />Zoning Atlas of Cabarrus County which is on file in the Cabarrus County Planning <br />and Zoning Department and included by reference. <br /> <br />(2) <br /> <br />Petition 90-19. Henry and Pat Duncan, Hilton Lake Road, <br />Map/PIN 5632-69-3930. Wishes to rezone from R-30 to ARR/SU. <br />The Planning Board voted 5-0 to recommend approval of this <br />petition. <br /> <br /> Dr. Nancy Randall reported that the Planning Board had placed the <br />following two restrictions on the rezoning request: (1). Submission of a site <br />plan showing the location of the kennel and its relationship to the house and <br />the property line and (2) the construction of a privacy fence. <br /> Mr. Jonathan Marshall, Planner, reviewed the location of the property and <br />the site plan as submitted by Mr. and Mrs. Duncan. <br />Chairman Simmons opened the public hearing for Petition 90-19 at 8:00 P.M. <br />Mr. David Roberts, self-employed engineer, reviewed the plans for the <br />kennel to be constructed by Mr. and Mrs. Duncan. He noted that Mrs. Duncan <br />plans to move 36 dogs to the facility from her current kennel located in Rowan <br />County. <br /> Robbie and Regina Beamon, who live adjacent to the Duncan property, spoke <br />in opposition to the proposed rezoning. Stating concerns regarding the number <br />of dogs to be housed in the kennel as well as the problems of noise and fleas, <br />Mr. and Mrs. Beamon requested assurances that the property would be maintained. <br />Also, seven other residents of the Hilton Lake Road area stood in opposition to <br />the proposed rezoning. <br /> Ms. Betsy Carpenter, President of the Cabarrus Animal Protection <br />Association, opposed the rezoning. She stated in her opinion that the tract of <br />property was not large enough to house a facility such as the one planned by Mr. <br />and Mrs. Duncan. <br /> There was no one else present to speak for or against the proposed <br />rezoning, and Chairman Simmons closed the public hearing at 8:40 P.M. <br /> Upon questioning by Chairman Simmons, Mrs. Pat Duncan agreed that a <br />maximum of 75 animals would be housed in the proposed kennel. <br /> UPON MOTION of Chairman Simmons, seconded by Commissioner Payne with <br />Chairman Simmons and Commissioners Payne, Barnhart, and Hamby voting for and <br />Commissioner Carpenter voting against, the Board approved Petition 90-19 by <br />Henry and Pat Duncan to rezone property located on Hilton Lake Road, Map/PIN <br />5632-69-3930, from R-30 to ARR/SU with the conditions that the Planning Board <br />has recommended relative to the property site plan on file in the Cabarrus <br />County Planning and Zoning Department and the construction of a privacy fence. <br />The Board further set the condition that 75 animals shall be the maximum number <br />of animals permitted in the kennel operation. <br /> <br />Zoning Text Amendment <br /> <br />(1) <br /> <br />Petition 90-ii(t). Planning and Zoning Department reporting <br />on this that has been requested by the Cabarrus County Board <br />of Commissioners. Request to amend Section 8 to create a <br />single County Planning and Zoning Commission to consolidate <br />the Planning Board and Board of Adjustment. Request would <br />also amend all board references in the Zoning Ordinance to <br />read Cabarrus County Planning and Zoning Commission. <br /> <br /> Mr. Gerald A. Newton, Planning and Zoning Director, reviewed the proposed <br />amendment which would establish the Planning and Zoning Commission comprised of <br />nine members, three county-wide appointments and six district appointments. He <br />asked that the Board delay appointments to the Commission in order to permit <br />interested individuals to apply for membership. The Board agreed to appoint the <br />members to the Planning and Zoning Commission on January 7, 1991. <br /> Chairman Simmons opened the public hearing for Petition 90-11(t) at 9:00 <br />P.M. There was no one present to speak regarding the petition, and Chairman <br />Simmons closed the public hearing for Petition 90-II(t). <br /> <br /> <br />
