635 <br /> <br /> UPON MOTION of Commissioner Hamby, seconded by Chairman Simmons and <br />unanimously carried, the Board adopted Petition 90-11(t) as recommended by the <br />Planning Board with regards to the consolidation of the Planning Board and <br />Zoning Board of Adjustment effective January 8, 1991. <br /> <br />Section Number and Name: Section 8 Board of Adjustment <br />Purpose of Change: Section 8 is being proposed to be changed to <br />read, "Section 8 Cabarrus County Planning and Zoning Commission." <br />Throughout the Section wording has been changed so as to create a <br />single County Planning and Zoning Commission. This is being <br />proposed by consolidating the existing Planning Board and the <br />current Board of Adjustments. In addition to establishing the new <br />board and detailing how members will be selected so as to better <br />represent the County population, the amended section establishes the <br />powers of the new Commission as both a planning agency as authorized <br />in General Statutes 153A-321 and 344, and as a board of adjustment <br />as authorized in G.S. 153A-345. <br /> <br />The request also amends all "board" references in the Zoning Ordinance to <br />read "Cabarrus County Planning and Zoning Commission." <br /> <br />Section 8 as amended reads as follows: <br /> <br />SECTION 8 CABARRUS COUNTY PLANNING AND ZONING COMMISSION <br /> <br />8.1 Establishment of Cabarrus County Planning and Zoning Commission <br /> <br /> In order to exercise the powers authorized in General Statute 153A- <br />321,344, and 345, the Cabarrus County Planning and Zoning Commission is hereby <br />established. The Commission shall be comprised of 9 members appointed by the <br />Cabarrus County Board of Commissioners. Members shall be residents of Cabarrus <br />County and representation shall be districted as follows: Township (T) 1 - one <br />member, T-2 - one member, T's 3 and 4 one member, and T's 5, 6 and 7 - one <br />member, T's 8 and 9 - one member, T's 10 and 11 - one member, and three at large <br />appointments. Members shall be appointed for three year terms. Members may be <br />reappointed into consecutive terms. Initial terms shall be 3 appointments at <br />1 year, 3 at 2 years, and 3 at 3 years upon initial appointments. <br /> <br />8~2 Powers of Commission: The Cabarrus County Planning and Zoning Commission <br />shall have the following duties: <br /> <br />8.2-1 As a planning agency, the Cabarrus County Planning and Zoning Commission <br />shall have the following duties: <br /> (1) Initiate proposed amendments to this order and make recommendations <br /> to the Cabarrus County Board of Commissioners. <br /> (2) Prepare studies and plans related to controlling and creating <br /> orderly growth and development of the county. <br /> (3) Develop and recommend to the Cabarrus County Board of Commissioners <br /> plans, goals, and objectives as well as policies, ordinances and <br /> administrative procedures or other means for carrying out the <br /> studies and plans of 8.2-1(2). <br /> (4) Perform any other duties assigned by the Cabarrus County Board of <br /> Commissioners as authorized in General Statute 153A-321 and 324. <br /> <br />8.2-2 As a board of adjustment, the Cabarrus County Planning and Zoning <br />Commission shall have the following powers of duties: <br /> <br />(1) Hear and decide variance applications as specified in 8.5. <br />(2) Hear and decide conditional use applications as specified in 8.6. <br />(3) Hear and decide appeals where it is alleged there is an error in any <br /> order, requirement, decisions, interpretation, grant, or refusal <br /> made by the Zoning Administrator as specified in 8.7. <br />(4) Hear and decide on change of one non-conforming use to another. The <br /> Board shall permit a change in use only if the new use is equally <br /> or more compatible with the area and the permitted uses in <br /> the district in which it is located as a non-conforming use. <br /> Application for a change of non-conforming use shall follow .... <br /> Section 9.2 General Standards. <br />(5) Perform any other duties assigned by the Cabarrus County Board of <br /> Commissioners as authorized in General Statute 153A-345. <br /> <br /> <br />
