636 <br /> <br />8,3 Planning and Zoning Commission Administration <br /> <br />8,3-1 The Commission shall adopt rules of procedures and regulations for the <br />conduct of its affairs. <br /> <br />8,3-2 The Commission shall elect a chairman and vice-chairman in accordance <br />with its rules of procedure. The Planning and Zoning Director shall appoint a <br />secretary for the Board of Adjustment. <br /> <br />8,3-3 Ail meetings of the Commission shall be open to the public. <br /> <br />8,3-4 The Gommission shall keep a record of its meetings, including the vote <br />of each member on every question, a complete summary of the evidence submitted <br />to it, documents submitted to it and all official actions. <br /> <br />8,3-5 The Commission shall give notice of matters coming before it by causing <br />a public notice to be placed in a newspaper of general circulation in the <br />county. The notice shall appear once a week for two consecutive weeks, the <br />first insertion to be not less than ten (10) days prior to the meeting date. <br /> <br />8,3-6 The person acting as Chairman of the Commission or the hearing officer <br />is authorized to administer oaths to any witnesses in any matter coming before <br />the Board. <br /> <br />8,3-7 Applications for conditional use approvals, applications for variances, <br />change of non-conforming use, and appeals for review of decisions of the Zoning <br />Official shall be filed with the Zoning Official as agent for the Board. <br />Applications and appeals shall be submitted on forms provided by the Zoning <br />Official. <br /> <br />8,3-8 It shall be the responsibility of the Zoning official to notify the <br />applicant or appellate to the application or appeal of the disposition which <br />the Commission made of this matter. This notice shall be made by certified <br />mail. <br /> <br />8,3-9 It shall be the responsibility of the Zoning Official to issue permits <br />in accord with the Commission action on an appeal or application, if a permit <br />is authorized by the Commission action. <br /> <br />8,3-10 The Zoning Official shall see to the faithful execution of all portions <br />of the Commission actions, including the enforcement of all conditions which may <br />have been attached to the granting of a variance or approval of a conditional <br />use. <br /> <br />8,4 Quorum and Vote Required <br /> <br /> 8,4-1 A quorum of the Commission, necessary to conduct any business of the <br />Commission shall consist of five members. <br /> <br /> 8.4-2 The concurring vote of at least eighty percent of the members of <br />the Commission present for the hearing shall be necessary in order: <br /> A. to reverse any order, requirement, decision or determination of the <br /> Zoning Official; or <br /> B. to decide in favor of the applicant any matter upon which it is <br /> required to pass by this ordinance when acting as a board of <br /> adjustment; or <br /> C. to effect any variation in this ordinance. <br /> D. to approve a change in non-conforming use. <br /> <br />8,4-3 A simple majority vote of those present shall be necessary to conduct <br />other business of the Commission and to deny applications and appeals. <br /> <br />8.5 Application of the Variance Power <br /> <br />8,5-1 A variance may only be allowed by the Cabarrus County Planning and Zoning <br />Commission in cases involving practical difficulties or unnecessary hardships <br />when substantial evidence in the official record of the application supports all <br />the following findings: <br /> <br /> <br />
