4.4 PATH DESIGN <br />4.3.1 When conducted by Motorola, path design services are based on formal field survey data <br />gathered under task 4.2. Path designs are considered final. The Project can move to the <br />implementation stage based on the recommendations within the final design report. Path <br />design Services include the following responsibilities: <br />4.3.3 In addition to warranty exclusions set forth in the agreement Motorola is not <br />responsible for excessive outages or degraded performance due to abnormal fading <br />conditions that include, but are not limited to: <br />• Formation of extreme radio refractivity gradients associated with: <br />• Exceptionally large temperature inversions, <br />• Abnormal temperature/humidity layers, <br />• Fog formation, <br />• Signal trapping caused by surface or atmospheric ducting; <br />• Reflections from unidentifiable off -path terrain features or physical structures; <br />• Rain fading due to rainfall rates that are more than the published rates or charts <br />used to predict rain induced outages; <br />If Motorola suspects abnormal propagation conditions are causing degraded system <br />performance, Motorola will reasonably assist Cabarrus County in verifying the <br />conditions leading to the degraded system performance.
