CABARRUS COUNTY DEVELOPMENT ORDINANCE <br />CHAPTER 16 -FLOOD DAMAGE PREVENTION <br />of the watercourse and the effects to properties located both upstream and downstream; and a map showing <br />the location of the proposed watercourse alteration or relocation shall all be submitted by the permit applicant <br />prior to issuance of a floodplain development permit. <br />(e) Certification Exemptions. The following structures, if located within Zone AE, are exempt from the <br />elevation/floodproofing certification requirements specified in hems (a) and (b) of this subsection: <br />(i) Recreational Vehicles meeting requirements of Part 5, Section B (6) (a); <br />(ii) Temporary Structures meeting requirements of Part 5, Section B (7); and <br />(iii) Accessory Structures that are 150 square feet or less meeting requirements o 5, Section B <br />(4) Determinations for existing buildings and structures <br />For applications for building permits to improve buildings and structures, inclCalterationovement, <br />enlargement, replacement, repair, change of occupancy, additions, rehabilitaubstantial <br />improvements, repairs of substantial damage, and any other improv ofildings and <br />structures, the Floodplain Administrator, in coordination with th din n: <br />(a) Estimate the market value, or require the applicant to ob prais f the market value prepared by a <br />qualified independent appraiser, of the building or structure re the t of construction of the proposed <br />work; in the case of repair, the market value he building or t all he the market value before the <br />damage occurred and before any repairs ar de; <br />(b) Compare the cost to perform the ve , the cost to repair a damaged building to its pre -damaged <br />condition, orthe combined costs proveme nd repairs, ifapplicable, to the market value ofthe building <br />or structure; <br />(c) Determine and document wroposed work constitutes substantial improvement or repair of <br />substantial damage; and <br />(d) Notify the applicanermm hat the work constitutes substantial improvement or repair of <br />substantial damage a hat a with the flood resistant construction requirements of the NC Building <br />SECTION[. DUTf59AND RESPONSIBILITIES OF THE FLOODPLAIN ADMINISTRATOR <br />The Floodplain Adlmi s a rm, but not be limited to, the following duties: <br />(1) w all PlIT <br />lain elopment applications and issue permits for all proposed development within Special Flood <br />Illryazard Areassure at the requirements ofthis ordinance have been satisfied. <br />(2) IR }}F�'all prded development within Special Flood Hazard Areasto assure that all necessary local, state and federal <br />perm YT �4¢j�een received, including Section 404 of the Federal Water Pollution Control Act Amendments of 1972, <br />33 U.S.C. 4. <br />(3) Notify adjacent communities and the North Carolina Department of Public Safety, Division of Emergency Management, <br />State Coordinator for the National Flood Insurance Program prior to any alteration or relocation of a watercourse, and <br />submit evidence of such notification to the Federal Emergency Management Agency (FEMA). <br />(4) Assure that maintenance is provided within the altered or relocated portion of said watercourse so that the flood - <br />Page 13 of 26 <br />2017 NC Model Ordinance Non -Coastal <br />Amended _2018 <br />Page 211 <br />
