CABARRUS COUNTY DEVELOPMENT ORDINANCE <br />CHAPTER 16 -FLOOD DAMAGE PREVENTION <br />Along rivers and streams where BFE data is provided by FEMA or is available from another source but neither floodway nor <br />non -encroachment areas are identified for a Special Flood Hazard Area on the FIRM or in the FIS report, the following <br />requirements shall apply to all development within such areas: <br />(1) Standards of Part 5, Sections A and B; and <br />(2) Until a regulatory floodway or non -encroachment area is designated, no encroachments, including fill, new <br />construction, substantial improvements, or other development, shall be permitted unless certification with supporting <br />technical data by a registered professional engineer is provided demonstrating that the cum a effect of the <br />proposed development, when combined with all other existing and anticipated developme i not increase the <br />water surface elevation of the base flood more than one (1) foot at any point within the co unity. <br />SECTION F. FLOODWAYS AND NON -ENCROACHMENT AREAS <br />Areas designated as floodways or non -encroachment areas are located within the S ial Flood H d Areas established in <br />Part 3, Section B. The floodways and non -encroachment areas are extremely rdous areas a to the velocity of <br />floodwaters that have erosion potential and carry debris and potential projectiles. following p inions, in addition to <br />standards outlined in Part 5, Sections A and e, shall apply to all developm 'nsuc as: <br />(1) No encroachments, including fill, new construction, substan 'mpr a nd other developments shall be <br />permitted unless: <br />TRI IJF Hi <br />9E1 fL� <br />TRI IJF <br />(a) It is demonstrated that the proposed encro ent would not r ny increase in the flood levels during <br />the occurrence of the base flood disc based on hydrolo and hydraulic analyses performed in <br />accordance with standard engineering and presented to the Floodplain Administrator prior to issuance <br />of floodplain development permit; QF <br />(b) A Conditional Letter of Map ron (C MR) has b approved by FEMA. A Letter of Map Revision (LOMR) <br />must also be obtained withiy�in completio ofthe proposed encroachment. <br />(c) In addition to subs5¢iiq (a) and a following standards apply to all fill activities in special flood hazard <br />areas: II II IIII <br />a.
