April 16, 2018 (Regular Meeting) Page 3518 <br />are hereby authorized to cooperate with the Underwriters in preparing and filing <br />such filings under state securities or "blue sky" laws (including special <br />consents to service of process) as the Underwriters may request and as the <br />Chairman of the Board of Commissioners, the County Manager or the Director of <br />Finance shall determine. <br />Section 9. The Finance Director shall prepare and file a sworn statement <br />of debt with the LGC and the Clerk to the Board in accordance with North Carolina <br />General Statutes Section 159-150. <br />Section 10. The County covenants that, to the extent permitted by the <br />Constitution and laws of the State of North Carolina, it will do and perform <br />all acts and things to comply with the requirements of the Internal Revenue <br />Code of 1986, as amended (the "Code"), in order to assure that interest paid <br />with respect to the 2018 Limited Obligation Bonds will not be includable in the <br />gross income of the owners thereof for purposes of federal income taxation, <br />except to the extent that the County obtains an opinion of bond counsel to the <br />effect that noncompliance would not result in interest with respect to the 2016 <br />Limited Obligation Bonds being includable in the gross income of the owners of <br />the 2018 Limited Obligation Bonds for purposes of federal income taxation. <br />Section 11. This Resolution shall become effective immediately upon its <br />adoption. <br />Thereupon, upon motion of Commissioner F. Blake Kiger, seconded by <br />Commissioner Lynn W. Shue, the foregoing resolution entitled "RESOLUTION <br />APPROVING INSTALLMENT CONTRACT FINANCING FOR VARIOUS PUBLIC PROJECTS IN AN <br />AGGREGATE PRINCIPAL AMOUNT UP TO $55,000,000 AND THE EXECUTION AND DELIVERY BY <br />THE CABARRUS COUNTY DEVELOPMENT CORPORATION OF CERTIFICATES OF PARTICIPATION <br />AND/OR LIMITED OBLIGATION BONDS RELATED THERETO, AUTHORIZING THE EXECUTION ANO <br />DELIVERY OF RELATED DOCUMENTS IN CONNECTION THEREWITH, AND PROVIDING FOR CERTAIN <br />OTHER RELATED MATTERS" was adopted and passed by the following vote: <br />AYES: Chairman Stephen M. The grant, entitled "CCPL: Plan and <br />Grown Together," would provide funding to hire a consultant to facilitate <br />strategic planning, and facilities assessment for the Cabarrus County Public <br />Library system. The end result would be a long-range strategic plan that <br />accounts for the area growth impacting the libraries. <br />If awarded, Cabarrus County would be required to match the grant with <br />$6,181. Award announcements are anticipated for May 2018, and the grant funds <br />would be available for FY19 upon acceptance and approval by the Board of <br />Commissioners. The intent of the presentation is to share the grant information <br />in preparation for the award announcements. <br />UPON MOTION of Commissioner Kiger, seconded by Commissioner Shue and <br />unanimously carried, the Board accepted the FY19 LSTA Grant Award to hire a <br />consultant for the library system, and provide the required $6,181 in matching <br />funds, should it be awarded. <br />(F-4) Sheriff's o£fica - Request to Award a Service Weapon to Lieutenant Milton <br />Daniel Harless Upon Retirement <br />Lieutenant Milton Daniel Harless will retire from the Cabarrus County <br />Sheriff's Office on May 1, 2018.
