Planning and Zoning Commission <br />Minutes <br />November 9, 2021 <br />The Chair asked if there was a motion to accept the as-built landscape plan as the project <br />landscape plan. <br /> <br />Ms. Morris said if the Board moves forward with this, we will need those to be added as <br />conditions and as part of that she would like to request that the applicant be responsible for <br />documenting those things on the site to try to help expedite Staffs visit. <br /> <br />The Chair said Mr. Jansen was shaking his head yes, that he will. <br /> <br />The Chair said based upon the two conditions that we have forth; the applicant will take care of <br />the strapping, the buffers along the roadway, to clean those up within the next 60 days. <br /> <br />Mr. Charles Paxton MOTIONED, SECONDED by Mr. Stephen Wise to APPROVE the as- <br />built landscape plan with the two conditions. The vote was unanimous. <br /> <br />The Chair said now we need a motion to accept or reject the revised glare study with the project <br />landscape plan with the two conditions pertaining to the strapping and cleaning up the buffers <br />along the roadway within the next 60 days. <br /> <br />Mr. Brent Rockett MOTIONED, SECONDED by Mr. Andrew Nance to APPROVE the <br />revised glare study based on the as-built landscape plan. The vote was unanimous. <br /> <br />The Chair asked Ms. Morris if this one counts even though we are going to have a condition. Do <br />we still need to do this one? <br />Ms. Morris said the Board could make a motion that issuing the Certificate of Compliance for <br />the project is contingent on meeting those two conditions and providing that documentation <br />along the way. But it would not be issued until Staff physically visits the site. <br />The Chair said the Board must determine if the applicant has met the conditions of approval and <br />accepts the referenced documents. The Board of Adjustment will need to consider allowing the <br />Zoning Certificate of Compliance (COC) to be issued for the overall site as it relates to terms of <br />approval established by the Board of Adjustment as part of case CUSE2018-00004, NC102 <br />Project, LLC. The ZCOC document provides official verification that the project is complete and <br />complies with the applicable standards of Cabarrus County Development Ordinance. <br />The Chair asked if there was a motion to issue the Certificate of Compliance contingent on the <br />two conditions previously stated, as well as the applicant documenting what they have done to <br />meet those conditions. <br />Mr. Brent Rockett MOTIONED, SECONDED by Ms. Ingrid Nurse to APPROVE the issuing <br />the Certificate of Compliance with the documentation and meeting both conditions. The vote was <br />unanimous. <br />14 <br /> <br /> <br />
