Planning and Zoning Commission <br />Minutes <br />December 14, 2021 <br /> <br />The Chair asked if any of the Board members had a conflict of interest or any information related <br />to the case. There being none, the Chair called on Mr. Phillip Collins. <br />Mr. Phillip Collins, Sr. Planner, addressed the Board presenting the staff report. <br /> <br />He said the subject property is ± 1.12 ac in size. <br /> <br />The purpose of this request is to install a new filtration system for the existing community <br />well located on the site. A new building to house and protect the system will be <br />constructed. Additional concrete will also be added for access. The use is permitted with the <br />issuance of a conditional use permit in the Countryside Residential (CR) zoning district. <br /> <br />The site currently supports an existing community well owned and operated by Aqua North <br />Carolina. Most of the site is wooded and vacant. The site is accessed from Byfield Drive via a <br />private access easement across 2730 Byfield Drive. The subject property is described as the <br />original well lot for the Cold Springs subdivision recorded in 1993. According to the recorded <br />plat, a 20-foot-wide drainage easement traverses the west side of the subject property. <br /> <br />The subject property is surrounded to the east, south and west by residential uses. A religious <br />facility borders the subject property to the north. <br />All uses permitted within the CR zoning district are currently allowed on the subject <br />property. However, the subject property is dedicated as the well lot for the Cold Springs <br />Subdivision. <br />The subject property is currently zoned CR (Countryside Residential), and is surrounded by <br />properties zoned CR. <br />The applicant has provided documentation compliant with Section 8-3 of the Cabarrus County <br />Zoning Ordinance, petitioning for a Special Use. <br />The Applicant has submitted a complete application and the application states that <br />approximately 190 SF will need to be cleared on the site for the new system. The rest of the site <br />will remain in its current state. <br /> <br />A public drainage easement traverses the western side of the subject property and the applicant is <br />providing buffering for it. <br /> <br />The subject property is located within the boundaries of the Eastern Area Plan and is designated <br />as Open Space. <br /> <br />Should the Board of Adjustment grant approval of the Special Use Permit, Staff requests the <br />following conditions become part of the approval and case record: <br /> <br />3 <br /> <br /> <br />
