Planningand Zoning Commission <br />Minutes <br />June 14, 2022 <br />At the hearing in April,Ms.Henson testified, as shown on the slide herethat she worked at this <br />location since February 2008. She said sheworked for the Billings andwas awareof the Billings <br />goals and plans to build an outdoor facility. The Billings are the previous owners of this facility. <br />The next exhibit isExhibit 3,thisis actually the Prospectusthat they received, that his clients <br />that are now seeking the variance received. It says that there is no outdoor pool at the present <br />time, but there is room on the premises to build one. So, there was a lot of outdoor space and <br />there isas it existstodaya lot of outdoor space which is whywe are here. <br />On another page:great opportunitiesfor this development,build an outdoor pool,there is ample <br />room on the premises to build an outdoor pool which would be a hugerevenue booster.So,when <br />this property was sold to myclients,theywere expecting and anticipating,thatin the future they <br />might expand and have an outdoor pooluse. <br />And so,now we get here for the necessity of thisVariance request,and that is a couple reasons: <br />the CabarrusCounty use rules have changed, buffer and setbacks requirements have also <br />changedfor outdoor recreationtype usesaswe have talked about,and thesurrounding <br />development approved by the Town of Huntersville has grownup around this property which <br />triggers someincreasedbuffers under the County code. Covidas testified byMr. Minier at the <br />last meeting, Covidhas changed things. So, an indoor facility relying 100 percent on an indoor <br />facility istough. So, to have outdoor usesis a benefit to the community as well as the operatorof <br />thelocation. Then,theunique shape of the property,coupled with theexisting fact that the <br />buildingis ploppedright in the middle of the site, makestrying to fit outdoor uses into this site <br />more difficult and that is why we are here for a Variance. <br />He said at the previous hearing,which was in April, there were a lot of question from this Board <br />that were unansweredand sopart of his job here tonight is to answerthose questions and that is <br />where we are going to start. <br />He said this is the previous plan (showed the plan). As you can see in the previous plan,the pool <br />was on the western side of the building. There was bermthat would be used for some outdoor <br />seating. On the southwestern side there was basicallyno planting alonga splashpad in an outdoor <br />area. The eastern side was used primarily for parking. There wereconcerns and there were <br />questions from this Board. <br />When he was retained,the first thingthathe did was listen to the hearing and make a list of those <br />concerns andtalked to hisproperty ownersand say how are we going to rework this site, because <br />it needs to be reworked. Variances are for the least amount of allowanceunder the Ordinance, <br />not that we expand as far as possible and eliminate the buffers. We need to incorporate and keep <br />as much of the buffer as possible.We are going to have to squeezethe site,andsothat iswhat <br />we have done. <br />13 <br /> <br />
