Planningand Zoning Commission <br />Minutes <br />June 14, 2022 <br />The applicant shall provide the pool plans to the Cabarrus Health Alliance for review and <br />approval prior to construction. <br />The applicant shall provide plans to Charlotte Water for review and approval prior to <br />construction of grading within the easement (along the eastern property line) is needed. <br />Mr. Koch said just say thatthe approval of these variances is conditioned based on these <br />conditions, they are a part of the approval. <br />Mr. Charles Paxton MOTIONED, SECONDEDbyMr. Jeff Corley,toAPPROVEthe <br />variances based on theconditions recommendedby Staff.The vote was unanimous. <br />Legal Update <br />Mr. David Goldberg addressed the Board giving afollow up and a status updateon theprevious <br />Arstark case. Today you approved the minutes for that and thenwe are going to be using that. <br />Because of the nature of the case,because of what we predictto happen going forward,we will <br />be spending a lot of time helping you work ontheFindings of Fact and Conclusions of Law in a <br />muchmore granular waythan you would normally beaccustomed to, so that is how that is <br />proceeding.He would expect to see those in the July meeting. <br />With that said, Mr. Pinto if you want to mention what you have seen,or he can tell a little bit. <br />Essentially, there has been an incident where Ms. Arstark has been contacting the spouse of one <br />of the members of the Board,and the spouseemployerandsaying rather derogatory remarks <br />on that regard. If you have had similar experiences do not hesitate to reach out to us. <br />We are looking at all of our optionsto discourage thatas much as possible.You all do not get <br />paid nearly enough to have to deal with that. But as always if you are contacted by any party <br />involved, especially in a Quasi-Judicial proceeding like an Appeal. Please notify Ms. Morris, me, <br />orMr. Koch as soon as possibleand we can work through options and next steps and take <br />appropriate actions. If you see things on social media or anything like that. <br />He said this case is on going in the sense that we still have to vote on the Findings and <br />Conclusions, and they say it is going to goto court,and the court may send it backherefor <br />further work for some reason. So, it is not done until it is done. He just wants to make the Board <br />aware of that. <br />The Chair said what is the status, is there a StopWork order? <br />Mr. Goldberg said right now,we are in a holding pattern. The decision is not official until the <br />Board approves the Findings and Conclusion order. At that point there is a 30-dayclock to <br />appeal and that is when it is kind of off to the races. <br />27 <br /> <br />
