12.Based on comments made by Board members at theApril 12, 2022 hearing, <br />Evolution reworked itssite planand variance requests for theJune 14, 2022 hearing <br />and hired a lawyer to present their revised requests. <br />13.The 200-footsetbacknearlycovers the entire Property as shown on the plan.The <br />parking buffer is effectivelya double buffer for the parking area that can be achieved <br />in a location not immediately adjacent to the parking. <br /> <br />14.The hardship with reference to this Property is not personal to Evolution or any <br />applicant. The Property has a unique shape with slantinglot lines. <br />15.The intent of the CCDOis to provide for organized development and in this case to <br />bufferandscreen residential uses. <br />16.The setback reduction is needed to allow new developmentsince nothing can be <br />developed with it in place. <br />17.The buffer reduction is onlyto allow certain paved areas to exist within therequired <br />buffer areas, such aswalking paths.The buffers are not reduced to allow accessory <br />buildings. <br />18.The most intensive outdoor structure, the Olympic pool,is positionedto the rear of <br />theexistingbuilding adjacent to the proposed open space which will be furthest <br />from the surrounding residential development. <br />19.Planting buffers along the most heavily dense residential uses on the west andeast <br />sides of the Propertyremainsintact except for the walking trail positioned at the <br />back of the buffering. <br />20.The fencing around the pool areas isfor safety reasons and is required by code. <br />21.Evolutionsrevised plan reducedthe impact on the buffers, rearranged the accessory <br />uses, rearranged parking spaces and removedaccessory structures from the buffer. It <br />also identified the parking countsandprovided the drainage/impervious calculations. <br />22.The requested 3 variances are 1)relief from the 200-footsetback,2)relief from the <br />51-footperimeter landscape buffer and 3) relief from the perimeter parking area <br />buffer,pursuant to the revised site plan. <br />Based on the foregoing Findings of Fact, the Board makes the following <br />4! <br />! <br /> <br />
