CONCLUSIONS OF LAW <br />1.This matter is properly before the Board,andthe Board adopts and incorporates by <br />reference the above Findings of Fact. <br />2.Evolutionprovided substantial, material and competent evidence to support each of the three <br />variance requests. <br />3.Unnecessary hardship would result from the strict application of the CCDO. It isnot <br />necessary to demonstrate that, in the absence of the variance, no reasonableuse <br /> can be made of the Property. <br />4.The hardship results from conditions that are peculiar to the Property, such as location, size, <br />or topography. Hardships resulting from personal circumstances aswell as hardships <br />resulting from conditions that are common to the neighborhood orthegeneral public, may <br />not be the basis for granting a variance. <br />5.The hardship did not result from actions taken by the applicant or the property owner. The <br />act of purchasing property with knowledge that circumstances exist that may justify the <br />granting of a variance shall not be regarded as a self-created hardship. <br />6.The requested variancesareconsistent with the spirit, purpose, and intent of theCCDO, <br />such that public safety is secured, and substantial justice is achieved. <br />Based on the foregoing Findings of Fact and Conclusions of Law, the Cabarrus County <br />Planning and Zoning Commission sitting as the Board of Adjustment hereby grants thethree <br />variancesconsistent with the site plan presented attheJune 14, 2022hearing.The votes by the <br />Board on each variance were unanimous.The special conditions for approval of thevarianceare <br />attached as Exhibit A and incorporated by reference.
