Staff Use Only: <br />PLANNING STAFF REPORT Approved: ____ <br />CABARRUS COUNTY PLANNING AND ZONING COMMISSION Denied: ____ <br /> Tabled ____ <br />Notice of Violation, May 7 Photos, Informal and Preliminary Notice of Buffer Violation, Stop <br />Work Order) <br /> <br />Prior to the site visits by Officer Lowe in July and then in September, the Appellant was in <br />contact with multiple staff members in Planning and Development about the requirements for <br />the road right-of-way, soil suitability testing application submittal requirements, permitting <br />requirements for a new home, pool, and an accessory structure (barn) to be located on the <br />property after the new home was built. (See Timeline for Staff Contacts and Emails) <br /> <br />February 25, 2020 - Appellant submitted for soil suitability analysis testing for property <br />located at 3233 Hahn Scott Road. <br /> <br />April 14, 2020 - The Appellant initiated contact with the Zoning Office in April of 2020 <br />regarding applying for a permit to build a new single-family home and how to apply for <br />soil suitability testing, also commonly known as a perc test, and a well permit. <br /> <br />6/12/2020-6/25/2020 During the month of June, the Appellant continued conversations <br />with Staff about permitting for the house, an accessory use (swimming pool) and the <br />right-of-way width requirements for the road. <br />The Appellant asked questions of Staff related to a barn. Appellant was informed that a <br />permit would be required for the accessory structure (barn). A letter would also be <br />needed from CHA to say that the accessory structure could be placed in the proposed <br />location without impacting the well and septic systems. <br /> <br />Findings <br /> <br />1.An accessory structure was constructed on the subject property some time prior to <br />July 7, 2021. <br /> <br />2.The accessory structure was constructed without proper permits in place. <br /> <br />Per Chapter 12, section 12-3, Zoning Compliance Permit <br />A Zoning Compliance Permit must be obtained from the Zoning Administrator <br />prior to the use or occupancy of any building or premises, or both, hereinafter <br />created, erected, changed, converted, or wholly or partly altered or enlarged in <br />its use or structure. <br />Additionally, no nonconforming structure or use can similarly be changed or <br />extended without a Zoning Compliance Permit or Certificate of Non-Conformity <br />Adjustment being issued. <br /> <br />
