Staff Use Only: <br />PLANNING STAFF REPORT Approved: ____ <br />CABARRUS COUNTY PLANNING AND ZONING COMMISSION Denied: ____ <br /> Tabled ____ <br /> <br />3.The accessory structure was constructed without a primary structure or use located <br />on the site. <br /> <br />Chapter2 of the Cabarrus County Development Ordinance (CCDO) defines <br />accessory use as a subordinate use of a building or use of land which is: <br />Conducted on the same parcel as the principal use to which it is <br />related, and <br />Clearly incidental to and customarily found in connection with the <br />principal use of the building, structure, or land. <br /> <br />4.The stream on the subject property is identified and classified as a perennial stream <br />per USGS maps. There are also identified wetlands on the site. (See USGS Map) <br /> <br />5.An accessory structure has been built in the required buffer. (See Survey #2). <br /> <br />6.Grading has occurred in the required buffer. (See Site Photos) <br /> <br />7.The wetland area on the subject property has been disturbed. <br />Per Chapter 4 of the Cabarrus County Development Ordinance, Section 4-10 The <br />requirements of the Waterbody Buffer Zone: <br /> <br />p A minimum 50-foot buffer shall be established from the stream bank on <br />all sides of perennial streams in addition to any lakes, ponds or <br />impoundments located along, or on, those streams. Perennial streams <br />include all rivers, streams, lakes, ponds, or waterbodies shown on the <br />USGS Quadrangle Maps as a solid blue line or identified in the Cabarrus <br />County Geographic Information System. <br /> <br />p A minimum 25-footbuffer shall be established along the edge of any <br />identified wetlands. <br /> <br />8.Survey provided by Appellant for structure in question clearly shows that it is in the <br />required buffer area. <br />Per Chapter 4 of the Cabarrus County Development Ordinance, Section 4-10 The <br />requirements of the Waterbody Buffer Zone: <br /> <br /> <br />
