A church is considered a religious institution and is classified in the institutional, civic and public <br />uses category. Institutional uses are permitted in residential zoning districts if supplemental <br />design and development standards are met. These standards are determined based on seating <br />capacity and zoning designation. If the seating capacity is 350 or less, additional design <br />standards must be met. A special use permit is required in residential districts where the <br />proposed total seating capacity is 351 or more. Gilwood Presbyterian Church has a seating <br />capacity of 350 or less and is therefore permitted based on additional design standards being <br />met. A Special Use Permit is not required. <br /> <br />For both CR and OI zoning jurisdictions design standards for religious institutionswith less than <br />351 seats include the following: <br />p Front on an arterial or collector road <br />The current site fronts on Odell School Road which is a major thoroughfare. <br />p The required setbacks of each zone shall be doubled is residential districts. <br />Currently the site meets the double setback requirement. <br /> <br />The OI zoning district serves as a transitional district between residential and commercial <br />districts. It is also the more appropriate district for institutional uses, like churches and schools. <br />The proposed zoning change to OI would provide greater flexibility for future use of the site, <br />including allowing additional impervious area and additional signage to be permitted on the <br />site. <br />This is a conventional rezoning request, therefore all uses permitted in the OI zoning district would be <br />allowed on the subject property if approved. The Planning and Zoning Commission should consider all <br />of the information provided and determine if the proposed rezoning is consistent with the <br />Commission’s vision for this area of Cabarrus County. <br /> <br />
