Conclusions <br />The proposed rezoning is not consistent with the Northwest Cabarrus Area Plan. However, the <br />subject property supports an existing religious institution which was constructed prior to <br />county zoning. The property currently has a residential zoning designation of CR. Rezoning <br />from CR to OI would not affect ordinance compliance. <br />The front portion of the subject property is located within the Coddle Creek WS-II watershed <br />protected area. The following requirements may affect future development of the site. Rezoning <br />would allow the current institutional use to expand up to the 75% impervious coverage (OI <br />requirement) rather than the 20% (CR requirement) within the watershed protected area. <br />All other residential and non-residential development shall not exceed twelve (12%) <br />percent built-upon area for the site in addition to meeting the applicable minimum lot <br />size, density, and zoning district requirements. <br />Lots that were developed prior to the adoption of the watershed regulations on <br />December 20, 1993 are considered grandfathered lots. Built-upon area, for purposes of <br />complying with the Watershed Overlay Zone standards, shall be determined by using <br />additions to the site occurring after the adoption date of this section of the ordinance. <br />Historical survey data, Cabarrus County Geographic Information Systems data and land <br />records data shall be used to determine the base built-upon area for Watershed Overlay <br />Zone compliance and for permitting purposes.
