Conclusions <br />The proposed rezoning is not consistent with the Eastern Area Plan. However, the subject property <br />supports an existing religious institution which was constructed prior to county zoning. The <br />property currently has a residential zoning designation. Rezoning from AO to OI would bring the <br />site into better compliance with the ordinance. The design standards for religious institutions with <br />less than 351 seats include two standards: <br />p Front on an arterial or collector road <br />The current site fronts on Rimer Road which is a major thoroughfare. <br />p The required setbacks of each zone shall be doubled is residential districts. <br />Currently the site does not conform to the double setback requirement. Rezoning to OI will <br />bring the site into compliance. <br />The currentimpervious coverage is currently over the maximum for AO zoning. Rezoning to OI will <br />bring the site into complianceand enable the applicant to expand. <br />The subject property is located within the Dutch Buffalo WS-II watershed protected area. The <br />following requirements may affect future development of the site. Rezoning would allow the <br />current institutional use to expand up to the 75% impervious coverage (OI requirement)rather <br />than the 15% (AO requirement) within the watershed protected area. <br />All other residential and non-residential development shall not exceed twelve (12%) <br />percent built-upon area for the site in addition to meeting the applicable minimum lot <br />size, density, and zoning district requirements. <br />Lots that were developed prior to the adoption of the watershed regulations on <br />December 20, 1993 are considered grandfathered lots. Built-upon area, for purposes of <br />complying with the Watershed Overlay Zone standards, shall be determined by using <br />additions to the site occurring after the adoption date of this section of the ordinance. <br />Historical survey data, Cabarrus County Geographic Information Systems data and land <br />records data shall be used to determine the base built-upon area for Watershed Overlay <br />Zone compliance and for permitting purposes.
