<br /> <br />Conclusions <br /> <br /> The front portion of the site is currently vacant; however, the rear of the site is occupied by two <br />storage buildings. <br /> <br /> According to aerial photo data, thefront of the subject property has always been vacant, and the <br />two accessory buildings appear to have been placed on the subject property sometime between <br />2001 and 2005. <br /> The rear portion of the subject property is zoned CR while the front portion of the property is <br />zoned LC. It has been zoned this way since 2003 when the rear portion of the lot was zoned Low <br />Density Residential (LDR).The historic zoning map from 1987 indicates that theentire property <br />was zoned LDR. <br /> <br /> Currently, the front portion of the lot would be considered a conforming lotunder the LC zoning <br />designation. <br /> <br /> If the entire lot were rezoned to CR, it would no longer be considered a conforming lot as it is less <br />than one acre in size and the minimum average lot widthis less than 150 feet. <br /> <br /> Rezoning the subject property would allow the property owner to construct a residence on the <br />property. <br /> <br /> The applicant states in his application that the lot is too small to accommodate a commercial use <br />and that a commercial use is not consistent with the surrounding properties. <br /> <br /> According to the historic zoning maps, the front portion of the subject property appears to have <br />been zoned LC since 1993. The rear portion of the subject property was zoned LDR until 2005 <br />when it was changed to CR. The LC zoning district does not permit single family residential uses. <br />There are two storage buildings located on the rear of the subject property. Aerial photography <br />reveals that the buildings were placed on the property between 2001 and 2005. There are no <br />permits on file for the buildings; therefore, these structures are considered non-conforming uses. <br />Rezoning of the subject property to CR would allow the property owner to construct a residence <br />and permit the storage buildings as accessory structures. This would eliminate the non- <br />conforming status of the subject property. <br /> <br /> The proposed rezoning request is inconsistent with the recommendations of the Midland Area <br />Land Use Plan for the subject property. However, single family detached residential uses are not <br />permitted within the Limited Commercial (LC) district and the applicant is proposing to construct <br />a residence on the property. <br /> <br /> <br />
