Conditions of Approval <br />Should the Board of Adjustment grant approval of the Conditional Use Permit, Staff requests the <br />following conditions become part of the approval and case record: <br />1.Site plan review and approval is required subsequent to Board of Adjustment approval in <br />order to ensure compliance with all applicable development requirements and conditions. <br />(Zoning) <br />2.The Granting Order, stating restrictions and applicable conditions of approval shall be <br />recorded with the deed for the property and prior to zoning permitting. (Zoning) <br />3.The applicant shall procure any and all applicable federal, state, and local permits prior to <br />zoning permitting. (Zoning) <br />4.Any proposed future expansion of property, as well as modifications or changes to <br />approved site plan, must receive Board of Adjustment approval in the form of an <br />amendment to the Special Use Permit. (Zoning) <br />5.The applicant shall provide copies of all state, local, and federal permits for the permanent <br />project file prior to zoning permitting. (Zoning) <br />6.Applicant shall comply with all applicable terms of NCDOT Driveway Permit C-1913. <br />(NCDOT/Zoning) <br />7.Prior to zoning permitting, the applicant shall have the Determination of No Hazard letter <br />from the FAA updated to address the current proposed tower height. A copy of the <br />updated letter shall be provided for the project file. (Zoning) <br />8.The applicant shall file the 7460-2 form with the FAA if the project is abandoned or within <br />five days after construction reaches its greatest height. A copy of said filing shall be <br />provided to Planning for the project file. (FAA) <br />9.The applicant shall submit a bond in the amount to accommodate 1.25 times the amount <br />of the estimate as required by Chapter 8, Number 36, Section 11 of the Cabarrus County <br />Development Ordinance. The estimated cost of removal and to return the site to its natural <br />condition is $105,178; therefore, the bond will need to be in the amount of $131,472.50. <br />The bond shall be submitted prior to zoning permitting. (Zoning) <br />10.Per the approved plans, the driveway will be increased to 26 feet wide, and a Knox Lock or <br />Knox Box shall be installed for Fire Department access. (Fire Department) <br /> <br />
