Planning and Zoning Commission <br />Minutes <br />October 11, 2022 <br />He said those are the four requirements that you need to find if you so choose to approve this <br />decision. There needs to be evidence on the record to support those findings. Then there will <br />need to be substantial and competent evidenceto support the findings for the specific <br />requirements. Those specific requirements are found in the Ordinance replicable to the Special <br />Use, the Wireless Communications Tower. So, then you have to work through those to make <br />sure,thereissufficient evidence to support afinding,to allow you to conclude as a matter of law <br />that those have been followed. That is the decision-makingframingbefore you. <br />The Chair asked if anybody else had anything. There being no further comments the Chair asked <br />if there is a motionto approve or deny. <br />Mr. Jeff Corley said the communication tower will benefit public health safety and welfare, <br />while providing improved wireless service in the area. Very limited transportation and <br />infrastructure need but there is an existing driveway that will be widened to accommodate access <br />to this new site. Wireless infrastructure is critical to the public for both telephone <br />communications and wireless internet access. <br />He believes the Board has handled all of the other ones through our conversations. He believes <br />they have fully met the Ordinance and their expert witnesses provided sufficient answers to some <br />of our concerns. <br />Mr. Charles Paxton MOTIONED, SECONDEDbyMr.Jeff CorleytoAPPROVESUSE2022- <br />000014Request for to construct a Wireless Telecommunications Tower (WTC),with <br />conditions recommended by Staff. It is in the public interest and with the statements made by <br />Mr. Corley. The vote was 8 to 1 to Approve with Ms. Ingrid Nurse voting against. <br />The Chair introducedAPPL2020-00002Appeal of Notice of Violation for operating an illegal <br />salvage yard, landfill, and fill in the SFHA. Appellants are John C. and Michelle McGraw. <br />Property address is 7005Flowes Store Road, Concord, NC,PIN 5537-56-4049. <br />Ms. Susie Morrisaddressed the Board stating that this is an appeal of a Notice of Violation. This <br />particular violation is for an illegal salvage yard, a land fill and for filling in the floodplain.The <br />apwas going to be out of the country and provided documentation that he filed <br />with the court for said out of country visit. So,they are asking that it be tableduntil next month. <br />If something should change,we will be back before the Board to let you know.
