Staff Use Only: <br />PLANNING STAFF REPORT Approved: ____ <br />CABARRUS COUNTY PLANNING AND ZONING COMMISSION Denied: ____ <br /> Tabled ____ <br />Per Chapter 3, section 3-8, Table of Permitted Uses <br /> <br />A salvage yard is not permitted in the Agriculture/Open Space district. <br /> <br />A sanitary landfill may only be permitted with a Special Use Permit. <br /> <br />p To date no Special Use Permit has been obtained for this property. <br /> <br />Per Chapter 12, section 3, Zoning Compliance Permit <br />A Zoning Compliance Permit must be obtained from the Zoning Administrator prior to the use <br />or occupancy of any building or premises, or both, hereinafter created, erected, changed, <br />converted, or wholly or partly altered or enlarged in its use or structure. <br /> <br />No nonconforming structure or use can similarly be changed or extended without a Zoning <br />Compliance Permit or Certificate of Non-Conformity Adjustment being issued. <br />p No permits have been obtained for either of the uses occurring on the subject property. <br /> <br />p The use of sanitary landfill is permitted in the Agriculture Open Space district and the Limited <br />Industrial and General Industrial districts with the issuance of a Special Use Permit. <br /> <br /> No Special Use Permit has been obtained for the subject property to operate a sanitary <br />landfill in the AO zoning district. <br /> <br />p The use of a Salvage Yard is limited to the General Industrial districts and is permitted based on <br />meeting additional development standards. <br />The subject property is zoned AO, therefore, a salvage yard it not permitted. <br />The property is subject to Floodplain Development Permitting. <br /> <br />p No floodplain development permits have been issued for this property by Cabarrus County. <br /> <br />The subject property is subject to Soil and Erosion and Stormwater permitting with NCDEQ due to the <br />amount of disturbance on the property. <br /> <br /> <br />
