Staff Use Only: <br />PLANNING STAFF REPORT Approved: ____ <br />CABARRUS COUNTY PLANNING AND ZONING COMMISSION Denied: ____ <br /> Tabled ____ <br />p No permits have been issued by the North Carolina Department of Environmental Quality <br />(NCDEQ) for soil and erosion control or stormwater as required for any land disturbing activity <br />that affects one or more acres on a tract of land. <br />The property is subject to the Waterbody Overlay District as it is bounded by the Rocky River, which is <br />a perennial steam. <br />p It is unclear at this time whether there are also violations of the Waterbody Overlay District on <br />the subject property. <br />The property owners run two businesses. One is a grading business, and the other is a concrete <br />recycling business. Equipment and vehicles located on the site, as well as materials used for fill, appear <br />to be items generally used by these types of businesses. (See Secretary of State Filings) <br /> <br />APPLICABLE SECTIONS OF THE CABARRUS COUNTY DEVELOPMENT ORDINANCE <br />Chapter 2 Definitions <br />LANDFILL, SANITARY - Any disposal facility or part of a disposal facility where waste is placed in or <br />on land, whether publicly or privately owned, and holding a permit from the State of North <br />Carolina. <br />SALVAGE YARD - An establishment operated for the purpose of storing, dismantling, salvaging, <br />recycling, buying or selling scrap or used materials such as paper, metals, rubber, rags, glass, <br />construction materials, wrecked, used or dismantled products and articles, such as machinery, <br />vehicles, appliances, manufactured homes, recreational vehicles, and the like. Also known as a <br />Junk Yard. <br /> <br />or Salvage Yard <br />Chapter 7, Performance Based Standards f <br />Section 7-1 Introduction <br />The purpose of this Chapter is to describe those uses, which may be approved administratively <br />by Planning and Zoning staff, known as "performance based standards" (PBS) uses. <br />Performance based standards uses are those which can be made compatible within a given <br />zoning district as long as pre-established standards are met which will control for any potential <br />negative effects of the use.
