1 The Board of Commissioners for the County of Cabarrus met at 9:00 A.M. on Friday, January 1, 1982, at the County Courthouse in Concord, North Carolina in an adjourned meeting for the purpose of reviewing the proposed Zoning Ordinance and Atlas as certified by the Planning Board and to approve any intended changes'to be made at the time of adoption of the Zoning Ordinance and Atlas. Present - Chairman: Ralph C. Bonds Commissioners: J. Harold Nash Troy R. Cook James W. Lentz Kenneth F. Payne Members of the Cabarrus County Planning Board present for the meeting were as follows. Mr. Billy Plummer Mr. John Cline Mr. Jack Rankin Mr. George Ingram spoke against the concept of zoning for Cabarrus County. Mr. John R. Boger, Jr., County Attorney, reported that he had talked with Mr. Richard Ducker, attorney at the Institute of Government, regarding the request to the Board to eliminate a race track as a conditional use ~n the ARR Zone in order to prevent construction of a race track in the area of Highway 601 and Joyner Road. He advised that the classification of race track remain as a conditional use in the ARR district. Mr. Boger explained that the developer of the race track now under construction will be required to provide proof that he can comply with all reqUired regulations and standards for that district as well as comply with the specific rules governing the conditional use in the ARR district before a conditional use permit can be approved. UPON MOTION by Commissioner Payne, seconded by Commissioner Lentz and unanimously carried, the Board accepted the recommendation of the Planning Board to classify a race track as a conditional use in the ARR district. UPON MOTION of Commissioner Lentz, seconded by Chairman Bonds and unanimously carried, the Board approved Subsection 9.2 General Standards as recommended by the Planning Board with the substitution of 9.6 Contents of Application for Approval of A Conditional Use for 9.2(A). The Board noted that all sections referring to Subsection 9.6 should be changed to read 9.2(A) to reflect this amendment to the ordinance. UPON MOTION of Commissioner Nash, seconded by Commissioner Cook and unanimously carried, the Board accepted Subsection 9.4-4 Planning Director Submits Recommendation to Board of Adjustment as recommended by the Planning Board. The Board accepted the Planning Board's recommendation to delete 9.8-4B(2) which required that the number of fuel pumps not be less than three (3) or more than seven (7) for location of the class of convenience goods in a district. UPON MOTION by Commissioner Cook, seconded by Commissioner Lentz and unanimously carried, the Board moved to delete paragraph (3) under Subsection 9.8-6(B) which required that permanent roads, defined as those to be used in excess of one year, within the excavation site and all permanent roads located with three~.hundred (300) feet of residentially zoned land be treated with a dust free material. UPON MOTION by Commissioner Nash, seconded by Commissioner Payne and unanimously carried, the Board amended'Paragraph B(8) of Subsection 9.8-6 Extraction of Earth Products to read as follows. The Board of Commissioners shall require for all extractive uses a performance guarantee.to insure that the provisions of the Rehabilitation Plan are met. Such performance guarantee shall be in a form approved by the County Attorney. The Board agreed to change 40 feet in Paragraph B(6) of Subsection 9.8-6 Extraction of Earth Products to 60 feet as the maximum height for spoil piles and other accumulations of by-products. UPON MOTION of Commissioner Cook, seconded by Commissioner Lentz and unanimously carried, the Board approved Subsection 9.8-7 Home Occupation, Rural of the original text of the ordinance in order that material in subsection corresponds with previous amendments to the Schedu e Regulations for this class.
