1 <br /> <br /> The Board of Commissioners for the County of Cabarrus met at 9:00 A.M. <br />on Friday, January 1, 1982, at the County Courthouse in Concord, North <br />Carolina in an adjourned meeting for the purpose of reviewing the proposed <br />Zoning Ordinance and Atlas as certified by the Planning Board and to approve <br />any intended changes'to be made at the time of adoption of the Zoning <br />Ordinance and Atlas. <br /> Present - Chairman: Ralph C. Bonds <br /> Commissioners: J. Harold Nash <br /> Troy R. Cook <br /> James W. Lentz <br /> Kenneth F. Payne <br /> Members of the Cabarrus County Planning Board present for the meeting <br />were as follows. <br /> <br />Mr. Billy Plummer <br />Mr. John Cline <br />Mr. Jack Rankin <br /> <br /> Mr. George Ingram spoke against the concept of zoning for Cabarrus <br />County. <br /> Mr. John R. Boger, Jr., County Attorney, reported that he had talked <br />with Mr. Richard Ducker, attorney at the Institute of Government, regarding <br />the request to the Board to eliminate a race track as a conditional use ~n <br />the ARR Zone in order to prevent construction of a race track in the area <br />of Highway 601 and Joyner Road. He advised that the classification of <br />race track remain as a conditional use in the ARR district. Mr. Boger <br />explained that the developer of the race track now under construction will <br />be required to provide proof that he can comply with all reqUired regulations <br />and standards for that district as well as comply with the specific rules <br />governing the conditional use in the ARR district before a conditional use <br />permit can be approved. <br /> UPON MOTION by Commissioner Payne, seconded by Commissioner Lentz and <br />unanimously carried, the Board accepted the recommendation of the Planning <br />Board to classify a race track as a conditional use in the ARR district. <br /> UPON MOTION of Commissioner Lentz, seconded by Chairman Bonds and <br />unanimously carried, the Board approved Subsection 9.2 General Standards as <br />recommended by the Planning Board with the substitution of 9.6 Contents of <br />Application for Approval of A Conditional Use for 9.2(A). <br /> The Board noted that all sections referring to Subsection 9.6 should <br />be changed to read 9.2(A) to reflect this amendment to the ordinance. <br /> UPON MOTION of Commissioner Nash, seconded by Commissioner Cook and <br />unanimously carried, the Board accepted Subsection 9.4-4 Planning Director <br />Submits Recommendation to Board of Adjustment as recommended by the Planning <br />Board. <br /> The Board accepted the Planning Board's recommendation to delete <br />9.8-4B(2) which required that the number of fuel pumps not be less than three <br />(3) or more than seven (7) for location of the class of convenience goods in <br />a district. <br /> UPON MOTION by Commissioner Cook, seconded by Commissioner Lentz and <br />unanimously carried, the Board moved to delete paragraph (3) under <br />Subsection 9.8-6(B) which required that permanent roads, defined as those <br />to be used in excess of one year, within the excavation site and all permanent <br />roads located with three~.hundred (300) feet of residentially zoned land be <br />treated with a dust free material. <br /> UPON MOTION by Commissioner Nash, seconded by Commissioner Payne and <br />unanimously carried, the Board amended'Paragraph B(8) of Subsection 9.8-6 <br />Extraction of Earth Products to read as follows. <br /> <br />The Board of Commissioners shall require for all extractive uses a <br />performance guarantee.to insure that the provisions of the Rehabilitation <br />Plan are met. Such performance guarantee shall be in a form approved by <br />the County Attorney. <br /> <br /> The Board agreed to change 40 feet in Paragraph B(6) of Subsection <br />9.8-6 Extraction of Earth Products to 60 feet as the maximum height for <br />spoil piles and other accumulations of by-products. <br /> UPON MOTION of Commissioner Cook, seconded by Commissioner Lentz and <br />unanimously carried, the Board approved Subsection 9.8-7 Home Occupation, <br />Rural of the original text of the ordinance in order that material in <br />subsection corresponds with previous amendments to the Schedu e <br />Regulations for this class. <br /> <br /> <br />
