The Board of Commissioners for the County of Cabarrus met in

special session at the Courthouse in Concord, North Carolina at 9:00 a.m.

on February 23, 1973.

Present - Chairman: S. Glenn Hawfield, Jr.
CoL~.~L~issioners: Robert A. McClary
Charles Ga llimore
C. Frank James
John A. Hammett

Chairmmn Hawfield opened the meeting and thanked the school boards

for their attendance. He stated the purpose of the meeting was to help
determine the priorities of the school systems, so this Board could perform
its duties to provide buildings and other necessary capital improvements.
The people of Cabarrus County are entitled to an explanation of the
advantages and disadvantages of the offer by Kannapolis Schools to accept
additional students.

J. Roy Davis, Jr., Chairman of the Concord City School Board,

stated that Hartsell, Hartsell, & Mills, Attorneys were the attorneys for
the Concord City and Cabarrus County Boards and that William L. Mills, Jr.
was present to represent these two boards. Mills stated that the Board of
Commissioners reluntantly called the bond election, which was defeated;
and therefore the current pressing needs exist. The General Statutes sets
forth the laws and regulations for preparing school budgets which include
a budget for the current expenses, capital outlay and debt service. He
luther.stated that the U. S. District Court sets the boundaries for the
county school district; therefore they could not accept the offer mmde by
Kannapolis City Schools without being subject to comtempt of court. The
problem of overcrowding is not in the Kannapolis area and the people have
violently objected to being moved.

Attorney Boger stated the Board was aware that the school system

operated under court order and that this meeting had been called in good
faith to bring about a productive session which would benefit a~l the
children of the county.

Chairman Raymond Ward of the Kannapolis City School Board made the

recommendation that a capital reserve account be set up to accumulate
money for construction pruposes. If this fund was set up, the Kannapolis
Board volunteered to loan their per capita share to Me county school
system which needed it most.
