368 <br /> <br /> The Board of Commissioners for the County of Cabarrus met at the <br />County Courthouse in Concord, North Carolina, on Thursday, January 9, <br />1986, at 7:00 P.M. for a public hearing on proposed Zoning Atlas and <br />Text amendments. This meeting had been delayed from January 2, 1986, <br />because of the holidays. <br /> Present - Chairman: James W. Lentz <br /> Commissioners: Kenneth F. Payne <br /> William G. Hamby, Jr. <br /> Archie Y. Barnhardt <br /> Marcelle M. Upright <br /> Mr. F. A. Rankin, Chairman of the Cabarrus County Planning Board, <br />presented each of the proposed amendments as recommended by the Planning <br />Board. Mr. Michael Byrd, member of the County Planning staff, reviewed <br />the location of the areas proposed for rezoning. Public input was <br />received regarding the proposed amendments prior to action by the Board <br />of Commissioners. <br /> <br />ZONING ATLAS AMENDMENTS <br /> <br />(1) <br /> <br />Petition 85-50. Myraden Pierce, Mr. & Mrs. Ben De Biase, Ms. Carol <br />F. East, township 2, Highway 49 West, Map/PIN 5518-94-5818, 93-3906, <br />5528-03-2406, 04-2575, 13-0246. Wishes to rezone from A-I to I-2. <br />Planning Board voted 5-0 to approve, with the portion North of <br />Highway 49 being rezoned to I-1 and the land South of Highway 49 <br />being rezoned to I-2. <br /> <br /> During discussion of the requested rezoning, it was noted that the <br />rezoning was requested to permit the relocation of Fabricated Products, Inc., <br />from Charlotte to Cabarrus County. <br /> No one spoke either for or against the rezoning. <br /> UPON MOTION of Commissioner Barnhardt, seconded by Commissioner Payne <br />and unanimously carried, the Board approved Petition 85-50 by Myraden <br />Pierce, Mr. and Mrs. Ben De Biase, and Ms. Carol F. East to rezone <br />property on Highway 49 West, Map/PIN 5518-94-5818, 93-3906, 5528-03-2406, <br />04-2575, 13-0246, with the portion North of Highway 49 being rezoned to <br />I-1 and the land South of Highway 49 being rezoned to I-2. <br /> <br />(2) <br /> <br />Petition 85-51. Ms. Mary Lee Abernathy, township 10, Map/PIN <br />part of 5535-00-9870. Wishes to rezone from ARR to I-1. The <br />Planning Board voted 5-0 to deny this request, feeling it was <br />inappropriate at this time. <br /> <br /> Mr. William L. Mills, III, attorney representing H & R Mullis <br />Machine Shop which has a contract for the purchase of the property, <br />spoke in favor of the rezoning to permit the relocation of a precision <br />machine shop from Mecklenburg County to the site. He stated the shop <br />would be compatible with the surrounding property and presented a petition <br />signed by adjacent property owners who were in favor of the rezoning. <br />Mr. Mills further stated the property was unsuitable for residential <br />purposes as it was located adjacent to the County's water tank site. <br />In conclusion, Mr. Mills complained there were no transitional classifications <br />from commercial to industrial zones in the County's Zoning Ordinance. <br /> Mr. George Long, resident who lives across the road from the property <br />requested for rezoning, spoke in support of the rezoning. <br /> During review of the petition, Mr. Thomas B. Robinson, Planning <br />Director, pointed out that rezoning the property to I-l~would constitute <br />spot zoning. <br /> A motion was made by Commissioner Barnhardt and seconded by Chairman <br />Lentz to approve Petition 85-51. <br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner Payne <br />with Commissioners Hamby, Payne, and Upright and Chairman Lentz voting <br />for and Commissioner Barnhardt voting against, the Board tabled the <br />original motion made by Commissioner Barnhardt. <br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner Payne <br />and unanimously carried, the Board instructed the Planning staff to <br />develop a line item relating to the size of machine tool manufacturing <br />shops and that the smaller machine tool manufacturing concerns be permitted <br />in A-I and ARR zones and other such zones as they consider appropriate. <br /> <br /> <br />
