466 <br /> <br /> The Board of Commissioners for the County of Cabarrus met at the County <br />Courthouse in Concord, North Carolina, on June 5, 1986, at 7:00 P.M. for a <br />public hearing regarding proposed Zoning Atlas amendments. <br /> Present - Chairman: James W. Lentz <br /> Commissioners: William G. Hamby, Jr. <br /> Archie~Y. Barnhardt <br /> Marcelle M. Upright <br /> Absent - Commissioner Kenneth F. Payne <br /> Mr. F. A. Rankin, Chairman of the Cabarrus County Planning Board, <br />presented each of the proposed amendments as recommended by the Planning <br />Board. Mr. Michael Byrd, member of the County Planning staff, reviewed the <br />location of the areas proposed for rezoning. Public input was received <br />regarding the proposed amendments prior to action by the Board of <br />Commissioners. <br /> <br />ZONING ATLAS AMENDMENTS <br /> <br />(1) <br /> <br />Petition 86-11. Ms. Annie Jane McCombs, township 4, Rogers Lake <br />Road, Map/PIN 5613(17)-21-2722. Wishes to rezone from RMF-6 to <br />C-1. The Board voted 4-0 to approve this petition. <br /> <br />There was no one present to speak either for or against the petition. <br />UPON MOTION of Commissioner Upright, seconded by Commissioner Barnhardt <br />and unanimously carried, the Board approved Petition 86-11 by Annie Jane <br />McCombs to rezone property on Rogers Lake Road, Map/PIN 5613(17)-21-2722, <br />from RMF-6 to C-1. <br /> <br /><2) <br /> <br />Petition 86-12. Lake Speed, township 5, off Old Salisbury Road, <br />Map/PIN 5632-79-3109. Wishes to rezone from R-30 to ARR. The <br />Board voted 3-1 to approve this petition. <br /> <br /> The Board reviewed the letter dated April 10, 1986, from Frank D. <br />Simpson, owner of parcel 5633-80-1579 which is located on Old Salisbury Road <br />adjacent to Lake Speed's parcel 5632-79-3109, requesting to join Mr. Speed <br />in his petition for rezoning and asking that his parcel of land be rezoned <br />to ARR. Mr. F. A. Rankin, Planning Board Chairman, also advised the Board <br />that although Mr. Speed had originally requested the rezoning of the entire <br />100 acres of land he had now agreed to the rezoning of approximately 20 <br />acres rather than all 100 acres. <br /> Mr. Lake Speed, property owner, stated that the rezoning of the <br />approximately 20 acres would be more than adequate for his purposes. <br /> Mr. Tom Grady, attorney representing Mr. Lake Speed, requested approval <br />of the rezoning petition. He stated that Mr. Speed planned to build a shop <br />approximately 400 feet behind his house for his NASCAR Race Team and that <br />noise would not be a problem because of the topography of the land. <br /> There was no one present to speak against the proposed rezoning. <br /> UPON MOTION of Commissioner Barnhardt, seconded by Commissioner Hamby <br />and unanimously carried, the Board approved Petition 86-12 by Mr. Lake Speed <br />to rezone the portion of Map/PIN 5632-79-3109 running from 750 feet south of <br />and parallel to the northern boundary of the property and to rezone Mr. <br />Frank D. Simpson's property, Map/PIN 5633-80-1579, to ARR. <br /> <br />(3) <br /> <br />Petition 86-13. Jerry L. Isenhour, township 4, off Lowe Avenue/ <br />Collingswood Drive, Map/PIN 5611(16)-74-5364. Wishes to rezone from <br />R-15 to O-I. The Board voted 3-1 to deny this petition. <br /> <br /> Mr. Ron Smith, who has contracted to buy the property subject to <br />rezoning, requested approval of the petition to allow the operation of a pet <br />grooming salon on the property. He stated he planned to upgrade the exist- <br />ing house and had received no negative comments from neighbors regarding his <br />plans for a pet grooming salon. Stating that the requested rezoning would <br />constitute spot zoning, Mr. Smith pointed out there are several other <br />businesses currently located in the neighborhood. <br /> Mr. Robert Critz, attorney, spoke in support of the requested rezoning. <br />He stated he was familiar with the operation proposed by Mr. Smith and that <br />the business would increase the level of integrity of the neighborhood. No one spoke in opposition to the requested rezoning. <br /> UPON MOTION of Commissioner Barnhardt, seconded by Commissioner Hamby <br />and unanimously carried, the Board approved Petition 86-13 by Jerry L. <br />Isenhour to rezone property off Lowe Avenue/Collingswood Drive, Map/PIN <br />5611(16)-74-5364, from R-15 to O-I. <br /> <br /> <br />
