77 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in recessed <br />session at the County Courthouse in Concord, North Carolina, on Monday, <br />April 10, 1989, at 3:00 P.M. <br /> Present - Chairman: James W. Lentz <br /> Commissioners: R. Giles Moss <br /> William G. Hamby, Jr. <br /> Martha H. Melvin <br /> Billy J. Simmons, Jr. <br /> UPON MOTION of Chairman Lentz, seconded by Commissioner Simmons and <br />unanimously carried, the Board authorized the Cabarrus County Agricultural <br />Extension Service to plant a tree on County property during activities on <br />May 8, 1989 in commemoration of the 75th anniversary of the North Carolina <br />Agriculture Extension Service. <br /> The Board agreed to meet with representatives of the Information and <br />Referral Agency of the United Way at 6:30 P.M. on April 17 to discuss the <br />the agency's request for $16,000.00 in County funds for Fiscal Year 1989- <br />1990. <br /> Mr. Michael M. Ruffin, County Manager, advised the Board that <br />photographs would be made of the Board members on April 17 at 2:15 P.M. <br /> UPON MOTION of Chairman Lentz, seconded by Commissioner Hamby and <br />unanimously carried, the Board moved to allow the Great American Circus <br />Association to operate a circus on Highway 29 on April 15, 1989, with <br />payment of proper permit fee to the Cabarrus County Tax Collector. <br /> Mr. Fletcher L. Hartsell, Jr., County Attorney, presented a petition <br />from Southern Star Cabarrus Investments, Inc. and Niblock Land <br />Investments, Inc., General Partners of Southern Star/Niblock Associates, <br />asking that Nantucket Court [a "deadend" road (the "Road/Easement")] as <br />described below be closed to the public. <br /> <br />Located in No.2 Township, Cabarrus County, Concord North <br />Carolina, as shown on the map of CLEAR SPRINGS FARM, SECTION <br />FOUR, recorded in the Office of the Register of Deeds of Cabarrus <br />County, North Carolina in Map Book 18, page 64. <br /> <br /> UPON MOTION of Commissioner Hamby, seconded by Chairman Lentz and <br />unanimously carried, the Board adopted the following Resolution Declaring <br />Intent to Close Easement Dedicated for Public Road. <br /> <br />NORTH CAROLINA <br />CABARRUS COUNTY <br /> <br />RESOLUTION DECLARING INTENT TO CLOSE <br /> EASEMENT DEDICATED FOR PUBLIC ROAD <br /> <br /> WHEREAS, at the April 10, 1989, meeting of the Board of <br />Commissioners for Cabarrus County ("the Board"), the Board acknowledged <br />a Petition to adopt a resolution and order closing the approximately 1025- <br />foot long Nantucket Court located in No. 2 Township, Concord, Cabarrus <br />County, North Carolina, as more particularly described in Map Book 18, <br />Page 64, of the Cabarrus County Registry (the "Road"); and <br /> <br /> WHEREAS, it is the intention of the Board to conduct a public <br />hearing, pursuant to N.C.G.S. 153A-241, to close the Road; and <br /> <br /> WHEREAS, the Board desires to notify the public regarding said <br />public hearing on the issue of closing the Road. <br /> <br />BE IT, THEREFORE, RESOLVED THAT: <br /> <br /> 1. A meeting and public hearing on the closing of Nantucket Court <br />shall be held before the Board at 7:30 P.M. on the 15th day of May, 1989, <br />or as soon thereafter as persons may be heard. <br /> <br /> 2. This resolution declaring the Board's intent to close said <br />easement dedicated as a public road shall be published in the Concord <br />Tribune on Monday, April 17 and 24, 1989, and May 1 and 8, 1989, and shall <br />be prominently posted in at least two (2) places along Nantucket Court. <br /> <br /> 3. At said hearing, the Board shall hear all interested persons who <br />appear with respect to whether the closing will be detrimental to the <br />public interest or to any individual property rights. <br /> <br />This the 10th day of April, 1989. <br /> <br /> <br />
