March 24, 2008 (Regular Meeting) Page 749 <br />The Board of Commissioners for the County of Cabarrus met in regular <br />session in the Commissioners' Meeting Room at the Cabarrus County <br />Governmental Center in Concord, North Carolina on Monday, March 29, 2008, at <br />6:30 p.m. <br />Present - Chairman: H. Jay White, Sr. <br />Vice Chairman: Joni D. Juba <br />Commissioners: Robert W. Carruth <br />Grace Mynatt <br />Coy C. Privette <br />Also present were John D. Day, County Manager; Richard M. Koch, County <br />Attorney; Mike Downs, Deputy County Manager; Pam Dubois, Deputy County <br />Manager; Kay Honeycutt, Clerk to the Board; and Lori Hinson, Deputy Clerk to <br />the Board. <br />Chairman White called the meeting to order at 6:33 p.m. <br />Girl Scout Troop 992 conducted the Flag Ceremony. Scouts participating <br />in the ceremony were: Maddison Hightower, Valerie Zacek, Hessy Sanders and <br />Julie Love. <br />Commissioner Carruth gave the invocation. <br />(A) APPROVAL OR CORRECTION OF MINUTES <br />UPON MOTION of Commissioner Privette, seconded by Commissioner Mynatt <br />and unanimously carried, the Board approved the minutes of January 7, 2008 <br />(Recessed Meeting), January 7, 2008 (Work Session), January 11, 2008 <br />(Recessed Meeting) and January 22, 2008 (Regular Meeting) as written. <br />(B) APPROVAL OF TEH; AGENDA <br />Chairman. White reviewed the following additions to the agenda and <br />supplemental information: <br />Addition to Consent Agenda: Item F-25 (Commerce Department - Budget <br />Amendment [Central Area Land Use Plan - $125,000.00]) <br />Addition to New Business: G-8 (Former First Union Bank Building - <br />Salloum Ventures, LLC - Buyer Possession Before Closing Agreement) <br />Addition to Appointments: H-5 (Central Area Land Use Plan Advisory <br />Committee) <br />Addition to Closed Session: L-2 (Closed Session - To Consult with the <br />County Attorney to Preserve the Attorney Client Privilege and to Discuss <br />Threatened or Pending Litigation) <br />Supplemental Information: Appointments to Board and Committees Item H- <br />5 (Central Area Land Use Plan Advisory Committee - Email from Susie Morris <br />Related to Concord's List of Potential Committee Members) <br />UPON MOTION of Commissioner Carruth, seconded by Commissioner Privette <br />and unanimously carried, the Board approved the Agenda with the <br />aforementioned changes. <br />(C) RECOGNITIONS AND PRE SENTATION3 <br />None. <br />(D) INFORMAL PUBLIC COMMENTS <br />Chairman White opened the meeting for Informal Public Comments at 6:37 <br />p.m. He stated each speaker would be limited to three minutes. <br />David Wightman, resident of 6026 Chardonnay Circle in Kannapolis, <br />reported he sent a letter to each Commissioner addressing the particulars of <br />his development case as they relate to the old and new Adequate Public <br />Facilities Ordinance (APFO). He said he started the process for a small 13 <br />unit upscale townhouse development in late April 2007 and finished the <br />approval process in January 2006. During this timeframe, he said he met with <br />city and county officials on many occasions and at no time did anyone inform <br />him of the new APFO and its impact. Having met all the development <br />requirements, he appealed to the Board to understand his situation. <br />
