34

UPON MOTION of Commissioner Payne, seconded by Commissioner Milloway
with Commissioners Milloway, Nash, and Payne and Chairman Lentz voting for
and Commissioner Barnhardt voting against, the Board appropriated $10,723.00
from the Contingency Fund to Capital Outlay/Animal Shelter to provide
funding for the recommended work at the Animal Shelter.
UPON MOTION of Commissioner Barnhardt, seconded by Commissioner
Milloway with Commissioners Barnhardt, Milloway, and Nash voting for
and Commissioner Payne and Chairman Lentz voting against, the Board moved
to go into Executive Session for legal advice in regards to the Cabarrus
County fairgrounds property.
UPON MOTION of Commissioner Nash, seconded by Commissioner Barnhardt
and unanimously carried, the Board moved to terminate the Executive Session.
Mr. John R. Boger, Jr., County Attorney, reported that the Board had
discussed the legal status of two parcels of land during the Executive
Session. The first parcel was the ll.98-acre tract that was conveyed to
the Cabarrus County Agricultural Fair, Inc., by deed in July, 1955, with
the reversionary provision that the land would revert to the County if it
ceased to be used for a fair. Mr. Boger reported that he concurred with
the letter from the Institute of Government stating the opinion that this
land was the property of the Fair Association subject only to the possibility
of reversion. The second tract of land discussed by the Board during the
Executive Session was the 8 to 10 acres located south of the fairgrounds
property on Union Cemetery Road. According to Mr. Boger, this second tract
of land is owned by Cabarrus County and has been used by the Fair Association
for the rides and carnival portion of the fair. Mr. Boger stated that he
had been instructed by the Board of Commissioners in the Executive Session
to negotiate with the Fair Association concerning the use by the Fair
Association of the County-owned property for future fairs after the 1984
fair scheduled for September. In conclusion, Mr. Boger~stated he would
make a report to the Board and to the public regarding this matter at a
later date.
Chairman Lentz stated that it was not the intent of the Board to
jeopardize the operation of the fair but to give the public the facts
regarding the fairgrounds property.
UPON MOTION of Commissioner Nash, seconded by Commissioner Payne and
unanimously carried, the Board declared the items as listed below as surplus
to the needs of the County and further resolved that these stated items be
disposed of by public auction on September 29, 1984, at 10:00 A.M.
Confiscated property and other unclaimed property in the possession of the
Sheriff's Department will also be offered for sale on that date. The public
auction is to be held in the parking lot of the County Office Building Complex.

DECLARATION OF SURPLUS PROPERTY

Hermes Calculator
IBM Electric Typewriters
National Bookkeeping Machines
Royal Manual Typewriter
Underwood Manual Typewriter
NCR Posting Machine
Wood Chairs
Climbing Apparatus Misc.
Print Dryer
Couches
Stainless Steel Commodes
Steel Office Chair
Lawn Mowers
3.5 Gallon Sprayer
Multi-Purpose Heavy Duty Sprayer
Chevy Hub Caps
Burroughs Adding Machine
Desk Typing Attachment

1 Set Volleyball Standards
2 Sets Hi-Jump Standards
4 Sets Hockey Goals

1 Presto Electric Heater
9 Chair Frames
1 Burroughs-Todd
2 Royal Electric Typewriters
1 Monroe Calculator
2 Swivel Chairs
1 Coffee Table
1 Burroughs Check Signer
1 Canon Copier
7 Plastic & Steel Chairs
7 Ffle Guides & Dividers
1 Flexowriter Automatic Writing
Machine
39 Shuffleboard Sticks 6 Lawn Mower Blades
1 Monroe Adding Machine
1 Steelmaster Index Cabinet
120 1500 Watt Incandescent Ballfield
Fixtures/Lamps
1 Set Balance Beam Standards
8 Office Chairs

50 Gallon Barrel of Scrap Parking Meter Parts
