Planning and Zoning Commission <br />March 19, 1992 . . . <br /> <br />Page <br /> <br />Springview Court, Concord, N.C. 28027, for a Variance to <br />permit him to construct a residential garage to house a <br />recreational vehicle (RV) which will exceed the maximum <br />height standards for an accessory structure and will also <br />encroach into the required side yard setback area. <br /> <br />Chairperson Randall asked if anyone who anticipate <br />speaking on this variance request, to stand and be sworn. <br />Sworn in were Mr. Michael Downs, Cabarrus County <br />Planning, Zoning and Building Inspection, Mr. Charlie <br />Mullis, Neighbor, Mr. James R. Edwards, Neighbor, Mr. Sam <br />Davis, Attorney for Mr. Trammell, and Mr. Robert <br />Trammell, Applicant. <br /> <br />Mr. Michael Downs, Zoning Administrator, addressed the <br />board presenting Variance Application 0105(V). Mr. Downs <br />submitted as evidence, Exhibit "A" Letter from Mr. Mark <br />Thompson, Environmental Health Specialist from Cabarrus <br />County Health Department stating that that is the proper <br />location of septic lines and that the current rules and <br />regulations require a minimum of 5 feet separation <br />between septic tank and any structure. Mr. Downs also <br />submitted as evidence Exhibit "B" two signed Affidavits <br />from adjacent property owners who's rear yards back up to <br />Mr. Trammell property, and a Tax Map~ and Exhibit "D" <br />Video Tape. <br /> <br />Mr. Amos asked Mr. Downs if a building permit has been <br />granted for the structure? <br /> <br />Mr. Downs stated no. The structure was started without <br />a permit. In talking with the property owner, they were <br />not aware that they needed a permit. They have stopped <br />work since that time. No permit has been issued because <br />of the location of the proposed structure. <br /> <br />Mr. Olio-Mills asked Mr. Downs at what time was Mr. <br />Trammell made aware that they needed a permit, and when <br />did they stop construction. He also asked Mr. Downs if <br />he issued a stop work permit. <br /> <br />Mr. Downs stated Mr. Trammell was made aware that he <br />needed a permit at the present stage of construction. He <br />stated one of the building inspectors had an inspection <br />located on the same road and happened to see construction <br />in process so he stopped and requested a permit. <br /> <br />Mr. Hartgen asked what date did the inspector stop. <br /> <br /> <br />
