It <br />was last month, and the following day or two, Mr. <br />Trammell came to the office and began the process. <br /> <br />Mr. Sam Davis, Attorney for Mr. Trammell, addressed the <br />board stating he would like to summarize the situation of <br />the hardship, the practical difficulties he has <br />encountered, and the fact that it will not do any <br />violence to the neighbOrhood as far as the general <br />appearance and characteristics that exist there in that <br />particular location. This building will not damage <br />anyone's property in the general area. Mr. Davis <br />submitted Mr. Mullis and Mr. Edwards affidavits as their <br />testimony in evidence and they will be available for any <br />cross-examination that the board would like. Mr. Davis <br />stated, "Mr. Trammell (quite honestly) said he did not <br />know that he needed a building permit, and as soon as the <br />building inspector came to him, he stopped his <br />construction and went to the Planning and Zoning <br />Department." Mr. Davis said what Mr. Trammell really <br />wants to do, is build a garage. He feels the garaged <br />vehicle would be better than a non garaged vehicle. Mr. <br />Trammell has lived On this property about 25 years. The <br />septic tank produced the major hardship because the <br />building has to be located 5 feet from the line, where <br />it is now, it is only 7 feet from the septic line. To <br />comply with the full side setback requirements, Mr. <br />Trammell would have to relocate his drain field. This <br />area is an area which percolation is not very good. The <br />septic tank system that he has is fragile. It is a day- <br />to-day thing to keep it going. In addition for Mr. <br />Trammell to utilize this shelter, it has to be in line <br />with his driveway because of the maneuvering of this <br />large recreational vehicle. 'What Mr. Trammell has is a <br />conflict between what the zoning ordinance wants to <br />accomplish and that is to have properties not infringe on <br />one another. In this case it would be open storage of a <br />vehicle. He said they think it is a genuine hardship in <br />this case, that it would not impact the neighborhood. <br /> <br />Mr. Robert L. Trammell, Applicant, addressed the board <br />stating, "this has been a hit and go situation from the <br />beginning because the soil is not very good for his <br />septic' tank." But his line at the present time is <br />working and he would not want to move it. <br /> <br />Chairperson Randall asked Mr. Trammell how long has the <br />line and septic tank been there? <br /> <br /> <br />
