Mr. Mannino said what they are showing to <br />the Board is the actual coverage that they have or do not have in <br />this particular area. <br /> <br />Mr. Hill said in looking through this packet he saw notice in <br />reference to conditional use request. He asked Mr. Mannino if he <br />submitted that. <br /> <br />Mr. Mannino said per their attorney that is standard submittal <br />material that they have to submit with all their applications. He <br />said they are not threating to sue the Board. <br /> <br />The Chair said in his six years on the Board that is the first time he <br />has seen this. <br /> <br />Mr. IVlannino said he apologize because he did not mean to offend <br />anybody. <br /> <br />Mr. Hill said it is truly offensive when you tell him that his decision, <br />whatever it may be, is arbitrary and capricious according to their <br />legal staff. Mr. Hill said it is totally offensive and he wants him to <br />bear that in mind should he ever appear before this body again, <br />because he takes great umbrage with it. <br /> <br />Mr. Mannino said again he apologize. He said in the legal process <br />they have been requested to submit that type of material with the <br />actual application forms written by an attorney for land use law. <br /> <br />The Chair said lets let it go at this time with the statement that this <br />board conducts its business in accordance with state law under the <br />judicial system. <br /> <br />Mr. Lancaster asked what kind of lighting is proposed for this tower <br />and what is the limit on FAA towers for that area. <br /> <br />Mr. ]elleme said they met the FAA lighting requirements. He said <br />they will have a beacon that changes red and white at the top, a <br />mid beacon and red beacons in the middle. Mr..lelleme said the <br />approval they got was 300-feet. <br /> <br /> <br />
