March 24, 2008 (Regular Meeting) Page 765 <br />for and Chairman White abstaining, the Board voted to reject the offer by the <br />Town of Midland to purchase right-of-way at the Rocky River Elementary School <br />for the purpose of the extension of the Monroe Natural Gas Pipeline. <br />Commissioner Carruth asked the County Attorney to investigate options <br />related to condemnation in the Agricultural Districts. <br />(G-4) Solid Waste Management - Mulch Give-Away <br />Rick Payne, Solid Waste Manager, presented a request to offer free <br />mulch to Cabarrus County citizens during the week of April 19-26, 2008, in <br />observance of Earth Day. There was a brief discussion and Commissioner White <br />asked Mr. Payne to track how much mulch is given away that week. <br />UPON MOTION of Vice Chairman Juba, seconded by Commissioner Mynatt and <br />unanimously carried, the Board voted to waive the fee for mulch during the <br />week of April 19-26, 2008 in observance of Earth Day. <br />(G-51 Fishertown - Potential Infrastructure Extension Scenarios <br />Kelly Sifford, Community Development Manager, presented information <br />related to infrastructure extension scenarios for the Fishertown community. <br />She reported the Board, at its March work session, decided not to be included <br />in a letter mailed to Fishertown residents from the City of Kannapolis. In <br />addition, she said a fact sheet was mailed with the letter identifying the <br />costs associated with annexation, additional services to be provided and <br />dates for two upcoming informational sessions. She said Kannapolis estimates <br />the project to cost approximately $6.5 million, anticipates there will not be <br />enough revenue to cover debt service and provided the following two options: <br />(1) annex the community and put them on a waiting list behind other <br />communities already in line; or (2) maintain status quo. She further <br />reported on two possible alternate courses of action: (1) the County becomes <br />a funding partner; and (2) the County pursues and receives Federal grant <br />funding. She stated the Fishertown community is not a competitive area for <br />grants. <br />There was a general discussion on the subject. The following issues <br />were addressed: the status of the survey; was the project included in the <br />TIF financing; cost to the residents if annexed by Kannapolis; possible grant <br />funding; etc. <br />Several Board members expressed a desire to wait until the survey has <br />been completed before taking action and a discussion on failed septic tanks <br />ensued. <br />UPON MOTION of Commissioner Carruth, seconded by Vice Chairman Juba and <br />unanimously carried, the Board voted to place the Fishertown - Potential <br />Infrastructure Extension Scenarios back on the work session agenda as soon as <br />the survey results are provided by Kannapolis. <br />(G-6) Reservation of Capacity Certificate for the Hurnt Mill Subdivision <br />As the owner/developer of the Burnt Mill Subdivision, Commissioner <br />Mynatt MOVED to recuse herself from the vote related to the Reservation of <br />Capacity Certificate for the Burnt Mill Subdivision. Commissioner Carruth <br />seconded the motion. The MOTION unanimously carried. <br />Susie Morris, Planning and Zoning Manager, presented the following <br />information related to a Reservation of Capacity Certificate for the Burnt <br />Mill Subdivision project: <br />Burnt Mill Development, LLC (1980 Highway 73 East, Concord, NC <br />28025) requests a reservation of capacity for Burnt Mill <br />Subdivision, which consists of 25 single-family residential lots <br />on +/- 90 acres located at the intersection of NC Highway 73 and <br />Crestmont Road in unincorporated Cabarrus County. <br />School Capacity Review <br />Burnt Mill subdivision will produce 14 students. The schools <br />impacted by the subdivision are W.M. Irvin Elementary School, <br />Concord Middle School and Concord High School. <br />The County's Capital Improvements Plan (CIP) includes <br />construction of an A.T. Allen Elementary replacement in 2009. <br />
