SECTION 1 <br />STATEMENT OF WORK <br />The terms and conditions of this Statement of Work are an integral part of the Motorola Service <br />Agreement or other applicable agreement to which it is attached and made a part thereof by this <br />reference. If there are any inconsistencies between the provisions of the Motorola Service Agreement <br />or other applicable agreement and this Statement of Work, the provisions of this Statement of Work <br />shall prevail. <br />1.1 ASSUMPTIONS <br />Motorola has based the system design on information provided by Cabarrus County Sheriff's Office <br />(CCSO) and an analysis of their subscriber requirements. Motorola has also relied on certain <br />assumptions in agreeing to provide Services described in the Agreement, including those listed. If <br />any assumptions prove to be incorrect or if any Customer obligations are not performed, Motorola's <br />ability to perform under this Agreement may be impacted and changes to the project schedule, fees, <br />deliverables, or other changes may become necessary. Such changes, including changes to the <br />equipment and scope of the project, will require a change order. <br />• CCSO IT department will configure their network to provide connectivity from remote locations <br />to CCSO HQ and Palmetto 800 Master site at Palmetto Center. <br />• CCSO has sole responsibility for Fleepmap and programming templates. <br />• The installation of the mobile equipment will be the responsibility of Cabarrus County. <br />• The installation of the mobile subscribers will be managed by the local Motorola partner. <br />• Any site installations will be performed during normal business hours 8:00am - 5:00pm Monday - <br />Friday. <br />• Where applicable CCSO will provide a mounting location (rack or cabinet), connectivity and <br />power for any equipment needed at a CCSO facility. CCSO will provide 120 VAC power outlets <br />within six (6) feet of each device proposed. Requiring power and provide an electrician, as <br />needed, for any additional electrical work. <br />• All subscriber installations should meet the minimum requirements for Motorola's "Standards <br />and Guidelines for Communication Sites" (R56). <br />• No environmental issues including, but not limited to, asbestos, structural integrity (rooftop, <br />water tank, tower, etc.) of the site, and any other building risks, are present at the installation <br />locations. <br />• Motorola may, at its convenience and in its discretion, provide replacement or upgraded <br />hardware, software and services with like products during the life of this Agreement. <br />• CCSO shall perform its obligations in a timely manner and in material accordance with the dates <br />and schedules. Decisions to be made by CCSO will be made promptly and without delay. <br />• Motorola will have no responsibility for the performance of other contractors or vendors engaged <br />by CCSO, or delays caused by them in connection with the project, even if Motorola has been <br />involved in recommending or selecting such contractors or in the monitoring of their work. <br />• CCSO acknowledges that Motorola may use its computers and management information systems <br />to develop the system and perform services under this Agreement.
