Cabarrus County Zoning Ordinance <br />Chapter 8- Conditional Uses <br />sites approved for towers or antennas, that are within the jurisdiction of Cabarrus <br />County, the City of Kannapolis, the City of Concord, the Town of Harrisburg, the Town <br />of Mt. Pleasant, the City of Locust or the Town of Midland. Such information shall <br />include specific information about the location, height, and design of each tower. <br />Each applicant shall also provide a one -year build out plan for all other proposed <br />wireless communications facilities within the County. The Zoning Administrator, <br />and /or his or her designee, may share such information with other applicants applying <br />for administrative approvals or conditional use permits under this Ordinance or with <br />other organizations seeking to locate towers or antennas within the jurisdiction of this <br />Ordinance provided, however that the Zoning Administrator, and /or his or her <br />designee, is not, by sharing such information, in any way representing or warranting <br />that such sites are available or suitable. Notwithstanding, '`' applicant is not required <br />to provide proprietary, confidential or other business infor on to justify the need <br />for the new wireless support structure, including do ps and <br />telecommunication traffic studies. <br />Section 5 Aesthetics r <br />b. The design of the buildings and related structures shall, to the extent possible, use <br />materials, colors, textures, screening, and landscaping that will blend them into the <br />natural setting and surrounding buildings located adjacent to the tower or antenna <br />site. <br />c. If an antenna is installed on a structure other than a tower, the antenna and <br />supporting electrical nd mechanical equipment must be of a neutral color that is <br />identical to, or closely compatible with, the color of the supporting structure. This is <br />in order to make the antenna, and related equipment, as visually unobtrusive as <br />possible. <br />d. LIGHTS- No tower or antenna shall have affixed or attached to it in any way except <br />during time of repair or installation, any lights, reflectors, flashers, day -time strobes <br />or steady night time light or other illumination devices, except as required by the <br />FAA, FCC or the County. This restriction against lights shall not apply to towers <br />which have been combined with light standards for illumination of ball field, parking <br />lots, playgrounds, or other similar public uses. If lighting is required, the lighting <br />sources and design shall be designed to create the minimum practicable penetration <br />of areas outside the boundaries of the Lot or Parcel. <br />e. STATE OR FEDERAL REQUIREMENTS- All towers and antennas must meet or exceed <br />current standards and regulations of the FAA, the FCC, and any other state or federal <br />government agency with the authority to regulate towers and antennas. If such <br />standards and regulations are changed, then the owners of the towers and antennas <br />governed by this chapter shall bring such towers and antennas into compliance with <br />the revised standards and regulations within six (6) months of the effective date of <br />such standards and regulations, unless a different compliance schedule is mandated <br />by the controlling state or federal agency. Failure to bring towers and antennas into <br />compliance with such revised standards and regulations shall constitute grounds for <br />the removal of the tower or antenna at the owner's expense. <br />f. BUILDING CODES, SAFETY STANDARDS- To ensure the structural integrity of towers <br />and antennas, the owners of such facilities shall ensure that they are maintained in <br />compliance applicable with standards contained in the State Building Code. <br />Chapter 8 Page 26 of 33 <br />Revised August, 2013 <br />Attachment number 4 <br />G -1 Page 376 <br />
