1 <br />GENERAL ORDER 1100 -04 <br />1 <br />l <br />i <br />2._ The need for assistance from other law enforcement agencies, military support and/or services <br />from other outside agencies should be determined as soon as possible. In any disaster <br />emergency situation, time is of the essence and the police department must take decisive <br />action. <br />3. Mutual aid support from other law enforcement agencies will be requested as the need arises, <br />1 <br />and in accordance with departmental policy. <br />i 4. All reasonable efforts will be made to preserve unit integrity of individual agency personnel <br />during the management of the incident. However, exercise of on -scene command and control <br />over all civil law enforcement resources committed to the operation will be under the Incident <br />Commander. <br />I. COURT & PROSECUTORIAL LIAISON <br />1. In the event of criminal activity, court and prosecutorial liaison will be established for the <br />purpose of mobilizing any needed court personnel and providing' legal advice to law <br />enforcement commanders. <br />J.. LEGAL AUTHORITY <br />1. Disasters and major incidents can.give rise to legal issues for police that in normal operations <br />would not be significant. Such issues may include, but are not limited to: <br />(a) Law Enforcement Mutual Aid Assistance; <br />(b) Statewidp Inter - Governmental Mutual Aid Compact;. <br />(c) Enforcement measures pursuant to a Declared State of Emergency; <br />(d) Military Assistance; <br />(e) Dissemination of sensitive or classified intelligence; <br />(f) Urgent necessity actions; and <br />(g) Actions taken pursuant to emergency management ordinances. <br />2. The Chief of Police and Incident Commander wilt be responsible for ensuring that the law <br />enforcement measures carried out as part of the emergency response are legally authorized. <br />3. Any questions regarding the legality of proposed actions by police personnel will be directed to <br />the City Attorney and /or District Attorney prior to the initiation of such action. <br />K. EVACUATION <br />1. Should the circumstances of an incident require the evacuation of residents or other persons <br />from a particular area, officers will conduct such action with the safety of the citizens as the <br />primary concern, giving consideration to their personal needs and concerns as well. <br />Departmental vehicles and other city vehicles may be used for transporting persons during <br />such evacuations. <br />2. The.American Red Cross is the agency responsible for the selection of sheltersites, as well as <br />the opening, operation and termination of evacuation shelters. Once the need for an <br />evacuation- of - -an -- area -- has been - determined, the -- Incident - Commander will advise the <br />Emergency Operations Center to contact the Red Cross for activation of a shelter. <br />Page 9 of 17 <br />F -15 <br />Attachment number 3 <br />Page 445 <br />
