CDM and the County agree that Resident <br />Project Representative presence is required if the Contractor is actively placing the landfill cap <br />system, excluding final seeding, that reasonable effort is required of the Resident Project <br />Representative to support CDM's project manager in the execution of Tasks 1.4,1.5,1.6, and 1.7 <br />irrespective of the Contractor's presence on site, and that labor costs for such reasonable effort <br />will be deducted from the RPR allowance defined in Task 2.1. A separate day-by-day log will be <br />kept of the RPR hours for construction observation and support of tasks 1.4 -1.7 so that the <br />County can track the expenditure of these hours. <br />County and CDM agree that CDM will be entitled to an amendment for additional <br />compensation based on the hourly rate provided above if the actual number of hours warranted <br />during construction exceeds 828 or if the contract time should extend beyond the 180 days to <br />Substantial Completion. However, only those hours worked and authorized in advance by the <br />County will be submitted for payment. Hours will be presented to the County on a weekly basis <br />for review. <br />The regular working hours for the Contractor are specified in the Contract Documents as 12 <br />hours per day Monday through Friday and 8 hours on Saturday between the hours of 7:00 a.m. <br />to 7:00 p.m. The Contract Documents require that the Contractor pay for any of the Engineer's <br />overtime costs should he choose to work outside regular working hours. The Engineer's costs <br />will be deducted from the Contractor's final pay request at the completion of the project. The <br />County agrees to pay the Engineer a like amount that is withheld from the Contractor to pay for <br />overtime services. <br />The RPR's communication concerning the project work shall, in general, be only with the CDM <br />Project Engineer or Construction Manager, Cabarrus County staff, and the Contractor. <br />Communication with subcontractors shall only be performed with the full knowledge of the <br />Contractor. Written communication with the County will be only through, or as directed by, <br />CDM. If, in the opinion of CDM, the Contractor's quality of work, level of effort, or work <br />schedule requires additional level of effort by CDM under this work task, then CDM will make <br />written recommendation regarding the scope of services under this task to the County for <br />consideration. <br />The RPR will be responsible for providing construction quality assurance for the project. <br />Specifically, the following tasks will fulfill the CQA requirements associated with the C&D <br />landfill closure. Documentation will be collected, assembled, and presented for Solid Waste <br />Section review certifying that the closure construction has been completed in accordance with <br />the applicable Permit Conditions and Contract Documents. CDM will be providing CQA <br />services for the installation of intermediate cover, the passive landfill gas collection and venting <br />system, the 40 mil LLDPE geomembrane, the geocomposite drainage layer, the protective cover <br />soil, the vegetative soil layer, and the surface drainage system. The contract documents require <br />the Contractor provide his own construction quality control (CQC) testing and oversight to <br />address the conformance testing specified in the Contract documents.
