2.5 USER RELIANCE, SPECIAL. TERMS AND CONDITIONS <br />The resulting report is provided for the use of Cabarrus County Parks Department, Rob Wallace, and the <br />architect (yet to be determined). Use of this report by any additional third parties will be at such party's <br />risk except when granted under written permission by the client and CESI. The additional party's use <br />and reliance on the report will be subject to the same rights, obligations, and limitations imposed on <br />Cabarrus County Parks Department. However, the total liability of CESI to all parties of the Phase 1 ESA <br />shall be limited to the remedies and amounts as protided in the Agreement as a single contract. The <br />additional party's use and reliance on the report shall signify the additional party's agreement to be bound <br />by the proposal and contract that make up the Agreement between CESI and Cabarrus County Parks <br />Department. <br />3.0 SITE DESCRIPTION <br />3.1 SfrE LOCATIONAND LEGP1. DESCRIPTION <br />The subject site is identified as a portion of Cabarrus County parcel number 5544836383 and al) of <br />1 parcel numbers 5544646749 and 5544724095 as indicated in Appendix A, Drawing 1. The subject site <br />is located near the intersection of Wallace Road and Highway 601 in Midland, Cabarrus County, North <br />Carolina and encompasses approximately 190 acres. The approximate location of the site is depicted on <br />'~ the USGS quadrangle presented as Appendix A, Drawing 2. <br />3.2 SITEANDGENERAI.VECWI7YCHARACTERISTICS <br />_ 1 The majority of the subject site consists of pasture and woodland. Aluminum cans and a stuffed chair <br />were observed within the wooded area in the northern portion of the subject site (Appendix C, Photo 1). <br />-~ A playhouse consisting of a tin roof with tarp walls filled with stuffed chairs and a compressed gas stove <br />was observed within the wooded area in the northern part of the subject site. Several shallow pits were <br />observed on parcel number 5544646749. However, only one pit contained debris in the form of go cart <br />7 fires, a chair and a tarp (Appendix C, Photo 2}. None of this observed debris is considered a recognized <br />environmenfal condlflon because it did not appear to be detrimental to the environmental integrity of the <br />subject site. <br />An overhead power line easement is located in the center of the subject site (Appendix C, Photo 3}. In <br />addition, another power line easement is present near the eastern border of the subject site. A four inch <br />black plastic pipe was observed draining onto the subject property from an adjoining residential property <br />to the west (Appendix C, Photo 5). Irrigation lines were observed throughout the subject site (Appendix <br />C, Photo 15). Muddy Creek was observed near the center of the subject site (Appendix C, Photo 16}. <br />The locations of specific items observed during the site reconnaissance are indicated in Appendix A, <br />Drawing 1. <br />A pond with an irrigation pump (in the former quarry area) was observed in the northeast portion of parcel <br />number 5544724095 (Appendix C, Photos 12 and 13). Mr. Wallace stated in his interview that the pump <br />was used to transport water to the Corning plant.
