Options to purchase or contracu which can be terminated or modified without

<br />143-215.1.
<br />(34) Non-domestic Wastewater /Sewaee. sl~all--mear2 Liquid wastes resulting from the processes
<br />employed in industrial, manufacturing, trade or business establishmenu, as distinct from domestic
<br />wastes.
<br />(35) NPDES or National Pollutant Discharge Elimination System. sHaN-rneaH A permit issued pursuant
<br />to Section 402 of the Act (33 U.S.C. 1342) or pursuant to N.C.G.S. 143-215.1 by the State under
<br />delegation from EPA.
<br />(36) Pass Through. °~^'~.,R ~--R,~:r A dischazge which exits the POTW into waters of the State in quantities
<br />or concentrations which, alone or in conjunction with a dischaz~e or dischazges from other sources,
<br />causes a violation, including an increase in the magnitude or duration of a violation, of ~
<br />reauirement and/or limit established in the POTW's NPDES Permit(s) and/or Non-dischazge
<br />Permit s and/or of any standard established in a downstream water quality standard.
<br />(37) Persoa °~°"~.,a„--~,a.m° ° My individual, firm, company, partnership, co-parlnershin, corporation,
<br />association, joint stock company, trust, estate, governmental entity, limited liability company or
<br />narmershia, or any other legal entity, or their legal representatives, agenu or assig~s. This definition

<br />(38) pH. shall~~neae A measure of the acidiry or alkalinity of a substance, expressed as standazd uniu, and
<br />calculated as the logarithm (base 10) of the reciprocal of the concentration of hydrogen ions
<br />expressed in grams per liter of solution. A pH value of 7.0 is neutral, above 7.0 is alkaline and below
<br />7.0 is acid.
<br />(39) Pollutank sl~all--n3ean Any "waste" as defined in N.C.G.S. 143-213 Q3) and dredged spoil, solid
<br />waste, incinerator residue, sewage, garbage, sewage sludge, munitions, medical wastes, chemical
<br />wastes, biological materials, radioactive materials, heat, wrecked or discarded equipment, rock, sand,
<br />cellar dirt and industrial, municipal, and agricultural waste and certain characteristics of wastewater
<br />(e.g., pH, temperature, TSS, turbidity, color, BOD, COD, toxicity, or odor).
<br />(40) Pollutant of Concern (POCI. Anv aollutant which might reasonablv be expected to be dischar e~
<br />the POTW in quantities which could pass throu~h or interfere with the POTW contaminate the
<br />slud~e, or'e~opazdize any POTW worker's health and/or safetv.
<br />(41) POTW Treatment Plant. sltaA-naean-tHa~ The portion of the POTW designed to provide treatment
<br />to wastewater.
