Subtenant shall be solely responsible for the use of the Land by its employees and <br />invitees and shall at all times ensure that such employees and invitees conduct themselves <br />in an appropriate fashion while using the Land so as not to be a nuisance to other persons <br />lawfully on the Land. Subtenant shall comply with and cause the occupancy and use of <br />the Premises to comply with all local, state and federal laws and regulations now or <br />hereafter applicable to the Premises and the occupancy or use thereof. <br />7. Subtenant Care of Premises. Subtenant shall: (a) keep the Premises in good order, <br />normal wear and tear excepted; (b) make repairs and replacements to the Premises <br />needed because of misuse or negligence by Subtenant, its employees, agents and invitees; <br />'and (c) not commit waste. Sublessor will use its best efforts to enforce the obligations of. <br />Prime Lessor under the Prime Lease with regard to Prime Lessor's obligations to <br />maintain the Land, including the Common Areas (defined below). <br />8. Sublessor Care of the Facility. Sublessor shall make timely repairs and replacements <br />to permanent fixtures located within leased space. Permanent fixtures include, without <br />limitation, doors, walls, lighting, carpet, tiles or other flooring, plumbing, and heating and <br />cooling systems. Any permanent fixtures needing repair resulting from misuse of the <br />Subtenant will be repaired and the expense of the repair will be billed to the Subtenant. <br />9. Subtenant Use of Land Common Areas. Subtenant and its agents, employees and <br />invitees have the non-exclusive right to use of the Common Areas of the Building and of <br />the Land to the extent reasonably necessary for Subtenant's operations and in accordance <br />with the intended and normal use and purpose for such Common Areas. "Common <br />Areas" include bathrooms, common entrances, lobbies, auditorium, board room, parking <br />areas, driveways, grounds and other similar public areas and access ways necessary for <br />Subtenant and its invitees to have access to the Premises. Subtenant's use of the Common <br />Areas shall be subject to rules and regulations of Prime Lessor and Sublessor as may be <br />reasonably promulgated from time to time, including without limitation, uses pertaining <br />to signage. Subtenant may not use any Common Areas for sales, shows or other events. <br />Sublessor shall be responsible for maintaining a standard set up (chairs and tables) for the <br />Auditorium and Board Room. If set up other than standard is required for a meeting, the <br />Sub lessee will contact General Services via the work order system with proper <br />notification and a fee of $25 will be charged for the set up. <br />Sublessor shall use reasonable efforts to keep the Common Areas available to Tenant, its <br />employees and business invitees in reasonably good condition and reasonably free of <br />rubbish. The use of Common Areas shall at all times be subject to such reasonable rules <br />and regulations as Prime Lessor or Sublessor may promulgate uniformly for all tenants <br />and to all applicable governmental rules and regulations. Additionally, Prime Lessor and <br />Sublessor reserve the right to redesign or reconfigure parking facilities so long as such <br />party does not materially obstruct or impede the traffic and customer flow through the <br />Land to and from the Building (except for such temporary inconveniences as may be <br />necessary for construction purposes). The Sublessor shall remove snow and ice from all <br />entrances as soon as possible should a severe weather event occur. The Sublessor shall <br />remove the snow and ice prior to the opening of the Human Services Center, if at all <br />possible. <br />~-- ~ a. <br />
