<br />CABARRUS COUNTY DEPARTMENT OF AGING <br />LUNCH PLUS CLUB CONTRACT FOR FOOD SERVICES - FY'2007 <br /> <br />THIS AGREEMENT entered into and becoming effective the first day of July 2006 by <br />and between Canteen Vending Services hereinafter referred to as the "Caterer", and <br />Cabarrus County Department of Aging, hereinafter referred to as the "Purchaser". <br /> <br />FOOD CONTRACT SPECIFICATIONS <br /> <br />WHEREAS, the Purchaser desires to engage the Caterer to render seNices in <br />connection with the LunchPlus Club Program, hereinafter referred to as the "Program", <br />provided through the Older Americans Act grant funds provided to the Purchaser <br />through the Centralina Council of Governments Area Agency on Aging from the North <br />Carolina Division of Aging and Adult SerVices and the United States Department of <br />Health and Human SeNices; and <br /> <br />WHEREAS, the Caterer is a food seNice management company with the demonstrated <br />capacity and desire to supply seNices; <br /> <br />NOW THEREFORE, in consideration of the premises and the mutual covenants and <br />agreements hereinafter contained, the parties hereto agree as follows: <br /> <br />The Caterer agrees to sell and the Purchaser agrees to buy all Purchasers' <br />requirements for this Program according to the provisions of the agreement. Caterer <br />agrees not to sub-contract for the delivery of the seNices called for in this agreement. <br /> <br />This Agreement will be in effect and seNices will be delivered beginning July 1, 2006, <br />and continue through June 30, 2007. This contract may be renewed a maximum of two <br />(2) times upon agreement of both parties. (This document represents the first renewal <br />of this contract). <br /> <br />The Purchaser will order from the Caterer approximately 250-280 meals daily for <br />approximately 250 seNing days, depending on the availability of funding and <br />participation levels within the Program. Caterer shall be obligated to deliver meals to <br />four (4) LunchPlus Club locations designated by the Purchaser, if funding allows these <br />four (4) sites to remain open, and any additional sites as added by the Purchaser. <br /> <br />The Caterer will deliver meals in bulk to each LunchPlus Club location Monday through <br />Friday during the period of this agreement with the exception of the holidays specified <br />herein or except as provided within the terms and conditions of this contract. <br /> <br />Independence Day Holiday.......................
