<br />Presented at June 19th Meeting by Betty Lipe <br /> <br />Cabarrus County Board of Commissioners <br /> <br />RESOLUTION # <br /> <br />RESOLUTION CALLING FOR A MORATORIUM ON <br />ANNEXATION BY <br />ALL THE MUNICIPALITIES WITHIN CABARRUS COUNTY INTO <br />THE <br />PROPOSED CITY OF ODELL <br /> <br />-------------------------------------------------------------------------------------.------ <br /> <br />WHEREAS, a petition was filed in the North Carolina Legislature, on August 9, <br />2005, for the incorporation of Odell, North Carolina in the northwest <br />area of Cabarrus County; and <br /> <br />WHEREAS, said petition was heard on May 15, 2006 and was approved to <br />go to Phase II of the incorporation process; and <br /> <br />WHEREAS, it is apparent to this Board of Commissioners that the annexing <br />into said jurisdiction continues to be controversial, if not illegal; and <br /> <br />WHEREAS, the Community of Odell is in the process of revising the <br />existing land use plan for said Area as part of this process, and <br />this board has found that the citizens of the area are fearful of annexation <br />whether voluntary or involuntary, and is in the process of verifying and <br />challenging the legalities of previous annexations, along with the <br />incorporation process; and <br /> <br />WHEREAS, this Board feels the need to know the impact and legalities of <br />such annexations on its citizens in said area such as increased <br />property taxes, the time frame all city services are provided to <br />the newly annexed property owners, and the effect of such <br />scattered annexations; and <br /> <br />WHEREAS, a study should be done immediately on the impact present and <br />future annexations in this area will have on the County's <br />budget, on sales tax and on the citizens of the areas of said <br />annexations; and <br /> <br />WHEREAS, this Board is of the opinion that a moratorium should be <br />placed on the annexation by any municipality in the North <br />West Area of Cabarrus, known as Odell, until a comprehensive <br />study can be done to reflect the economic impact, legalities <br />and their incorporation effort is considered complete, and will <br />have on this County and all it's citizens; and. <br /> <br />E.- \ <br />
