'19

Mr. Griffin said Mr. Hliinter indicated that he would hire somebody to do an
analysis to show us what the dangers and all are and he asked for 30 days to do
that. He said he does not think that is unreasonable.

The Chair asked Mr. Misenheimer would he be willing to table this until our next
session.

Mr. Misenheimer said he wish the neighbors had talked to him.

The Chair said that he ~annot help with. He said what he is trying to do is find a
likeable conclusion to what we are trying to do here this evening that makes
everybody go home with a smile on their face. The Chair said the Board wants
everybody to have a fair chance. He said the City of Midland was not contacted
because he talked with the city officials.

Mr. Griffin said he has' one question. He asked Mr. Misenheimer if he actually
have a design for this plant. Mr. Griffin said does he have anything that Mr.
Hunter can analysis.

Mr. Lentz said he can simplify this a little for the Board. He said he is not clear
what direction he might be going so he wants to make clear about the voting
procedure. Keep in mind that the first vote is legislative you do not need the
evidence on that. Th~ evidence is required for the second vote, which is the
conditional use permit! part. So, as a legislative vote 'it does not fit in the
community sort of thing, That is something where you can look at poiicy and
make that decision and not have to be based on those technical studies. Mr.
Lentz said if it is going in a direction of it not fitting in with the community, you
may not want to require someone to go and do an expensive study if that is the
direction you are going;

Mr. Griffin said it is kind of hard to say that we can make a decision on rezoning
it when he stood here i~ front of the Board and said he is going to put a concrete
plant on it. He said he does not know how you can disassociate those two.

The Chair said at this poinfit does not fit with the Midland Area Plan. If the city
fathers and the zoning planning in Midland decide find that fits with our plan, we
can accept that. I

Mr. Lentz said there i$ some text in there that says if those areas are zoned
industrial then they can continue in that kind of fashion. That is where we saw
the consistence as being industrial. He said what he is suggesting to the Board

Gr-5
