I

'20

is this. When they look at the list of uses that is being proposed, you look at
that in a legislative fashion. If you feel in a legislative fashion that concrete
plants just are not wanted in this area that is a legislative decision that you do
not have to necessarily back up with a lot of technical evidence.

The Chair said he would like to hear from the people who controis the area. He
said he thinks that the City of Midland should have been informed so that they
could have at least written a letter and said yes this is an acceptable process for
our city or no we do not want it. He said that gives them a better judgment cali.

The Chair said he would like to suggest that the Board table this for a month.

Mr. Misenheimer said he would like to make a comment. He said he had 32
acres and he thought when he rezoned it, because it was on the front of that
paper concrete plant, it would be alright. Mr. Misenheimer said when he went to
get his permits he was told the zoning he needs was on the bottom of that page.
He said he did not rezone the whole thing.

There being no further comments Mr. Griffin MOTIONED to Table Petition C05-
02(R CU) for thirty days, seconded by Lancaster.

Mr. Koch said you should consider that we are already in the middle of a public
hearing and sworn testimony. He said since the Board is going to have more
testimony next time the proper thing would beto recess the public hearing.

Mr. Griffin MOTIONED to recess this public hearing until the March meeting,
seconded by Mr. Lancaster. The vote was unanimous.
Petition C05-02(R CU) Recessed

Director's Report

Mr. Lentz passed out the Explanation of Changes to the Cabarrus County Zoning
Ordinance, Chapter 8 - Section 8-4, Number 28 Wireless Telecommunications
Services for the Board's review.

Mr. Lentz said the Board was given an invitation for the moratorium meeting for
the public on February 28, 2005 at J.M. Robinson High School at 7:00 p.m. .

=-= 'Vhe={:-l'lai1=3Sked",Mr"_leB.!'z"""lo.w,,,mal'ly,,,meetings..Rod1edatenQ-:0fbd:1a',ljflgd;i:l['()lJ98~---'-
out these next several months.

Mr. Lentz said the next big event will be in late March. He said the first thing he
would suggest to the Board is that they try to attend the meeting on Monday,
February 28, 2005 at J.M. Robinson High School at 7:00 p.m.

&-5
